تبنت دولة الإمارات في السنوات الأخيرة مجموعة من التشريعات والقوانين والمراسيم التي تتوافق مع مستحدثات العصر وتواكب التقدم التكنولوجي الذي أصبح أسلوبا للحياة، يتصدرها عنوانا لتلك النهضة التشريعية -في نظرنا-قرار مجلس الوزراء رقم (٢) للعام ٢٠١٨ في شأن المسؤولية المجتمعية للشركات والمنشئات بدولة الإمارات العربية المتحدة، وما تضمنه من إنشاء المنصة الذكية المسؤولية المجتمعية. في هذا الإطار، يجب أن ينظر إلى الشركة على أنها مؤسسة اجتماعية، وباعتبارها جزءا من المجتمع، يجب أن تكون مسؤولة عن أفعالها تجاه جميع الأطراف الأخرى في المجتمع. ويخفي مفهوم مسؤولية الشركات الاجتماعية نقاشات وجدل؛ ابتداء من تعريفه حتى كيفية تطبيقه. ويستهدف القرار المذكور تحقيق مجموعة من الأهداف، تأتي في مقدمتها الحاجة إلى وضع الإطار التنظيمي لمساهمات المسؤولية المجتمعية وآليات توثيقها وإدارتها وتوجيهها في دولة الأمارات العربية المتحدة، يقترن بوضع إطار عام للحوافز والامتيازات لممارسة المسؤولية المجتمعية، كل ذلك في إطار تحديد الأدوار والمسؤوليات للجهات المعنية بشأن تنظيم وتحفيز المسؤولية المجتمعية لدى الشركات والمنشئات. وقد حرص القرار على بيان المبادئ التي يقوم عليها مفهوم المسؤولية المجتمعية. وقد تضمنت أحكام القرار النص على إنشاء صندوق يسمى" الصندوق الوطني للمسؤولية المجتمعية". وقد نص القرار على أن ينشئ الصندوق منصة ذكية للمسؤولية المجتمعية، تهدف إلى تنظيم المساهمات الاختيارية في المشاريع والبرامج التنموية المدرجة في المنصة وتوثيق وتنسيق جهود المسؤولية المجتمعية. ويكون إدراج المشاريع والبرامج في المنصة من خلال إدخال الجهات المعنية بالتنسيق مع الجهات المستفيدة للبيانات والمعلومات والمستندات الخاصة بالمشروع أو البرنامج في المنصة إليكترونيا، وفق الإجراءات التي يصدر بشأنها قرار من مجلس أمناء الصندوق. ويكون إدراج الشركات والمنشئات إلزاميا وقد يكون اختياريا. وتلتزم الشركة بالإفصاح على موقعها الإلكتروني. يجب على الشركة أو المنشأة قبل تجديد ترخيصها السنوي لدى الجهة المعنية الإفصاح من خلال المنصة عن مساهمتها أو عدم مساهمتها في المسؤولية المجتمعية عن الفترة السابقة لتاريخ التجديد. يصدر الصندوق علامة وجواز للمسؤولية المجتمعية ويتم تسجيل كل منهما كعلامة تجارية مملوكة للصندوق. وللصندوق إجراء تقييم مؤسسي للشركات والمنشئات المتقدمة للحصول على العلامة أو الجواز. وتتمتع الجهة المستفيدة المدرجة في المنصة بمركز قانوني يخولها حقوقا ويحملها بالتزامات.
In recent years, the UAE has implemented a series of legislations, laws, and decrees aligned with modern developments and reflective of technological progress, which has become an integral part of daily life. At the forefront of this legislative evolution, in our perspective, is Cabinet Resolution No. (2) for the year 2018 concerning the social responsibility of companies and establishments in the United Arab Emirates. This resolution includes provisions related to the establishment of the smart social responsibility platform. Within this framework, companies are considered social institutions, and as integral parts of society, they bear responsibility for their actions towards all other stakeholders. The concept of corporate social responsibility sparks discussions and controversies, ranging from its definition to its practical application. The aforementioned decision aims to achieve several goals, with a primary focus on establishing a regulatory framework for social responsibility contributions and defining mechanisms for documenting, managing, and directing such contributions in the United Arab Emirates. Additionally, it sets a general framework for incentives and privileges related to the exercise of social responsibility. These efforts are part of defining the roles and responsibilities of the relevant authorities in organizing and promoting social responsibility among companies and establishments. The decision emphasizes the principles underlying the concept of social responsibility. Notably, the provisions of the decision include the establishment of a fund named the "National Fund for Social Responsibility." The decision mandates the Fund to establish a smart platform for social responsibility, with the goal of organizing voluntary contributions to development projects and programs featured on the platform. The platform is designed to document and coordinate social responsibility efforts. The inclusion of projects and programs on the platform is facilitated by the relevant authorities, in collaboration with beneficiary entities. They input data, information, and documents related to the project or program into the platform electronically, following the procedures outlined in a decision issued by the Fund's Board of Trustees. The listing of companies and establishments on the platform may be mandatory or optional. The company is obligated to disclose on its website. The company must disclose its social responsibility contributions or non-contributions for the preceding period before renewing its annual license with the relevant authority. The Fund issues a social responsibility mark and permit, both registered as trademarks owned by the Fund. The Fund reserves the right to conduct an institutional evaluation of companies and establishments applying to obtain the mark or permit.
