المستخلص: يعد حق انتصاف ضحايا الجرائم الدولية أثر يترتب على ثبوت المسؤولية الجنائية الدولية، لذلك أدرج النظام الأساسي المنشئ للمحكمة الجنائية الدولية الدائمة لأول مرة في تاريخ القضاء الدولي الجنائي، مصطلح "الضحايا" والاعتراف بحقهم في الانتصاف، من خلال توفير ضمانات كافية لحمايتهم وجبر أضرارهم جراء الجرائم التي تدخل في اختصاص المحكمة المرتكبة في حقهم. الأمر الذي جعل الضحايا فاعلين إيجابيين في العدالة الجنائية الدولية، من خلال مشاركتهم في سير الإجراءات القضائية وعرض مطالبهم وشواغلهم، مما يضع المحكمة أمام تحديات تتراوح بين حمايتهم من المخاطر التي يمكن أن يتعرضوا لها أثناء سير الدعوى من جهة وتحقيق جبر أضرارهم من جانب أخر، وذلك دون الإخلال بحقوق المتهم. بناء عليه تأتي هذه الدراسة، لتوضيح التطور الذي بلغته المحكمة الجنائية الدولية الدائمة في توفير الحماية الأمنية والقانونية لضحايا الجرائم الدولية، وكذا آليات جبر الضرر المتضمنة في نظام روما الأساسي، تحقيقا لحقهم في الانتصاف.

The right to remedy for victims of international crimes is an effect of proving international criminal responsibility. Therefore, and for the first time in the history of international criminal justice, the statute establishing the Permanent International Criminal Court included the term "victims" and the recognition of their right to remedy by providing adequate guarantees for their protection and reparation for their damages as a result of the crimes involved In the jurisdiction of the court committed against them. This situation made the victims positive actors in international criminal justice, through their participation in the conduct of the judicial proceedings and the presentation of their demands and concerns, which puts the court in front of challenges ranging from protecting them from the risks that they may be exposed to during the course of the case on the one hand, and achieving reparation for their damages on the other hand, and that without prejudice to the rights of the accused. Accordingly, this study comes to illustrate the development achieved by the Permanent International Criminal Court in providing security and legal protection to victims of international crimes, as well as the reparation mechanisms included in the Rome Statute, in order to achieve their right to a remedy.
