المستخلص: تتميز الترجمة القانونية بالتعقيد، خصوصا عند الترجمة بين قانونيين مختلفين للغاية مثل القانون العراقي والإسباني، حيث يلعب الاختلاف في الثقافة واللغة والأنظمة القانونية بشكل خاص دورا مهما للغاية في الترجمة ويجعل عملية الترجمة أكثر صعوبة بالنسبة للمترجم. في هذا البحث سنتناول حالة التكافؤ وعدم التكافؤ في ترجمة نصوص المواريث من العربية إلى الإسبانية وسوف نستشهد بتصنيفات التكافؤ المذكورة وفقا لأبرز اللغويين، ونتحدث بالتفصيل عن كل نوع، وكذلك عن دوره في اللغة القانونية، ونقوم بتحليل بعض المستندات القانونية العراقية مثل الوصايا والقسام الشرعي، مع إبراز نوع التكافؤ في كل مصطلح وفي حالة عدم وجوده نحدد أفضل تقنيات للترجمة كما سنتطرق إلى مصادر القانون العراقي المستعارة من الإسلام، والتي بدورهـا تزيد من تعقيد إجراءات الترجمة.

Legal translation is characterized by complexity, especially when translating from two very different legal systems such as Iraqi and Spanish, where the divergence of culture, language and especially legal systems play a very important role in the translation and makes the translation process even more difficult for the translator. In this research we will address the case of (in) equivalence in the translation of succession documents from Arabic to Spanish, we will cite the classifications of said equivalences according to the most prominent linguists, speaking in detail of each type, and also of their role in legal language, Then we analyze some Arab legal documents, more precisely from Iraq, highlighting the type of equivalence in each term and in case it does not have one, highlighting the best translation procedure. We will also address sources of Iraqi law that are borrowed from islam, and that, in turn, further complicates the translation procedure.

La traducción jurídica se caracteriza por la complicación, especialmente a la hora de traducir de dos sistemas jurídicos muy diferentes como el iraquí y el español, donde la divergencia de la cultura, la lengua y sobre todo los sistemas jurídicos juegan un papel muy importante en la traducción y hace el proceso de la traducción aún más difícil para el traductor. En esta investigación abordaremos el caso de (in)equivalencia en la traducción los documentos de sucesión del árabe al español, citaremos las clasificaciones de dichas equivalencias según los lingüistas más destacados hablando detalladamente de cada tipo, y también de su papel en el lenguaje jurídico, luego analizaremos unos documentos jurídicos árabes, más precisamente de Irak, destacando el tipo de equivalencia en cada término y también indicamos si dichos términos carecen de equivalencia, resaltar el mejor procedimiento de la traducción. También abordaremos las fuentes del Derecho iraquí que son tomadas del islam, y eso, a su vez, complica más el procedimiento de la traducción.
