ويتكون البحث من ثلاثة مباحث، تسبق هذه المباحث مقدمة، وتعقب هذه المباحث خاتمة وفهرس المراجع. المقدمة، وتشتمل على أهمية البحث وأسباب اختياري له، وأهداف البحث وغايته. المبحث الأول: (تعريف المفتي والفتوى ومنزلته)، وفيه مطلبان: المطلب الأول: تعريف المفتي والفتوى والمستفتي، المطلب الثاني: منزلة المفتي والحاجة إليه. المبحث الثاني: (شروط وضوابط المفتي)، وفيه ثلاثة مطالب، المطلب الأول: شروط المفتي، المطلب الثاني: ضوابط المفتي، المطلب الثالث: الخصال التي يجب على المفتي أن يتصف بها. المبحث الثالث: (الآثار المترتبة على فتوى المفتي)، وفيه مطلبان، المطلب الأول: أثر المفتي الحق في رشاد الأمة، المطلب الثاني: الآثار السيئة لأخذ الفتوى عن غير أهلها. وأخيرا جاءت الخاتمة، قدمت أهم ما توصلت إليه من نتائج وتوصيات.
This research consists of three topics, preceded by an introduction, and followed by a conclusion and index of references. The introduction includes the importance of the research and the grounds of the selection, and the objectives and purpose of the research. The first topic (definition of the mufti and fatwa and his home) includes two requirements. The first requirement is the Definition of the Mufti, Fatwa and his stature which requires two things. The first being the definition of the Mufti, Fatwa and the respondent. Whereas, the second requirement is the stature of the mufti and the reason he is needed. The second topic (conditions and the controls of Mufti) includes three requirements. The first one is the terms of the mufti, the second is the controls of the Mufti, and the third requirement is the characteristics that the mufti should be characterized by. The third topic (Effects on the fatwa of the mufti) requires two things, the first is the impact of the true mufti on leading the nation to the right path. The second requirement is the bad effects of taking the fatwa from the nonprofessionals. Finally, the main findings and recommendations were presented.
