|a يهدف هذا البحث إلى عرض التجربة التشريعية في مجال الوقف، للجزائر باعتبارها من الدول المعترفة بالوقف، كنظام مالي قائم بذاته بنوعيه: الوقف العام والوقف الخاص، أو ما يعرف بالوقف الخيري والوقف الذري، وذلك عبر المراحل الثلاثة الشهيرة التي شهدها هذا الإقليم عبر التاريخ وهي: مرحلة ما قبل الاستقلال والتي سيطر فيها نظام الحكم العثماني الإسلامي وبعده جاء الاستعمار الفرنسي ثم المرحلة الانتقالية بعد استقلال البلاد حيث عرف التشريع اضطراب بسبب مخلفات الاستعمار الفكرية، لنختم بالمرحلة الراهنة للأوقاف وما انتهت إليه من تشريع.
|b This research aims to present the legislative experience in the field of endowment, to Algeria as one of the countries recognizing the cessation, as a stand-alone financial system of both types: the general endowment and the special cessation, or the so-called charitable endowment and atomic cessation, through the three famous stages witnessed in this region throughout history: the pre-independence period in which the Ottoman-Islamic regime took control and then came French colonialism and then the transitional phase after the independence of the country throughout the country: the pre-independence period in which the Ottoman-Islamic regime took control and then french colonialism and then the transitional phase after the independence of the country.
