المستخلص: يتناول البحث دراسة موضوع الحجر على السفيه سفها طارئا من حيث بيان حقيقة الحجر والسفه الطارئ، ووقت ابتداء الحجر عليه وانتهائه. والسفه الطارئ هو الذي يحدث بعد البلوغ والرشد، وذلك بأن يبلغ الإنسان عاقلا رشيدا ثم يصير سفيها يضيع ماله ويفسده. ويعرف الحجر للسفه الطارئ: بأنه منع الحر المكلف من التصرف في ماله عند حدوث خفة تعتريه وتحمله على التصرف بالمال على خلاف مقتضى العقل أو الشرع. وهذا الموضوع له أهمية كبيرة في مجال التقاضي، ويحتاج إلى معرفة أحكامه عموم المتعاملين بالتجارة، والقضاة الذين يحسمون الخصومات في الوقائع التي ترفع إليهم. وقد تناول البحث بيان حقيقة الحجر للسفه الطارئ، ووقت ابتداء الحجر على من كان سفهه طارئا، ووقت انتهاء الحجر عليه، والإشهاد على الحجر للسفه الطارئ، ثم ختم البحث بدراسة تطبيقية على الأنظمة واللوائح العدلية في المملكة العربية السعودية. وختم البحث بخاتمة تضمنت ملخصا لأهم نتائج البحث وتوصياته.

The research deals with the study of the subject of putting endowment on the foolish in an emergency, in terms of clarifying the reality of endowment, the emergency foolishness, and the time of the beginning and end of endowment on him. Emergency foolishness is what occurs after puberty and maturity, and that is when a person reaches a sane and rational person, then becomes foolish, wasting his money and corrupting it. Endowment for emergency foolishness is defined as preventing a free person who is charged from disposing of his money when something happens to him, and it forces him to dispose of money contrary to the requirements of reason or Sharia. This topic is of great importance in the field of litigation, and it requires knowledge of its rulings by all those involved in trade, and the judges who settle disputes in the facts submitted to them. The research dealt with the statement of the reality of endowment for emergency foolishness, and the time of the beginning of endowment on the one whose foolishness was emergency, and the time of the end of endowment on him, and the testimony of endowment for the emergency foolishness, and then concluded the research with an applied study on the justice systems and regulations in the Kingdom of Saudi Arabia. The research concluded with a conclusion that included a summary of the most important research findings and recommendations.
