المستخلص: The subject of the study in this research is the moral element of crime in Islamic criminal jurisprudence.in which we demonstrate the basis of criminal responsibility in Islamic criminal jurisprudence on both the natural and moral personality.or rather the legal person theory. And the will as the basis of the moral element of intentional crime. explaining the effect of ignorance of the provisions of the true Sharia on both intentional and unintentional crimes.
