520 |a  تكفل الدول الديمقراطية لمواطنيها الحق في التمتع بالحقوق السياسية، كالحق في الانتخاب وحق الترشح وحق تكوين الأحزاب السياسية والمشاركة في التجمعات السياسية وتقلد الوظائف العامة، وبالتالي مشاركة الأفراد في إدارة شؤون الدولة بكل حرية لاسيما في الظروف العادية. إلا أن هذه الدول قد تمر بحالة من الاضطراب والتوتر تنعكس سلبا على هامش ممارسة الحقوق والحريات، وذلك بفرض مجموعة من القيود بهدف الحفاظ على النظام العام والمصلحة العامة. وفي ظل عدم إمكانية تطبيق القانون الدولي الإنساني على مثل هذه الحالات، وتطبيق المواثيق الدولية لحقوق الإنسان كضمانة لممارسة الحقوق والحريات بصفة عامة والحقوق السياسية بصفة خاصة لاسيما عندما تكون هذه الأخيرة سببا في حدوث هذه الاضطرابات، والتي تعتبر في مثل هذه الحالة ضمانة نسبية غير كافية لمواجهة السلطات التي تتمتع بها الدولة.  |b  Democratic states guarantee their citizens the right to enjoy political rights, such as the right to vote, the right to stand for office, the right to form political parties, to participate in political rallies, to hold public office, and thus to freely participate in the conduct of state affairs, especially under normal circumstances. However, these countries may go through a state of turmoil and tension that negatively affects the exercise of rights and freedoms, by imposing a set of restrictions in order to preserve public order and the public interest. In light of the inability to apply international humanitarian law to such cases, and the application of international human rights covenants as a guarantee for the exercise of rights and freedoms in general and political rights in particular, especially when the latter are the cause of these disturbances, which is considered in such a case An insufficient relative guarantee to counter the powers of the state.
