المستخلص: يهدف البحث إلى بيان حكم تهنئة أهل الكتاب في أعيادهم، كما يهدف إلى تجلية رأي ابن تيمية في حكم تهنئة أهل الكتاب بسبب ما ينسبه إليه بعض أصحاب الآراء التي تقول بالمنع، كذلك يهدف البحث إلى بيان حكم بناء الكنائس في ديار الإسلام. وقد اتبع البحث المنهج الاستقرائي الذي يتتبع آراء الفقهاء من مظانها الأصيلة، كما اتبع المنهج الاستنباطي التحليلي في بيان دلالات النصوص من الكتاب والسنة المتعلقة بهذه المسائل وبيان أصولها، وأثر اختلاف الأزمنة والعوائد فيها، كذلك اتبع البحث المنهج المقارن في عرض اختلاف الفقهاء في المسائل محل البحث، كما في تهنئة أهل الكتاب بأعيادهم، وبناء الكنائس -وهما المسألتان التي يكون فيهما تفصيل القول إن شاء الله تعالى-. وكان من أهم نتائج هذا البحث أنه يجوز الإهداء لغير المسلم وقبول هديته في غير ما نص الشرع على تحريم عينه كالخمر والخنزير، كما أن الشرع لا يمنع تهنئة غير المسلمين بأعيادهم عملا بالنصوص الواردة في التعامل معهم بالبر والإحسان، كذلك لا مانع من بناء الكنائس في بلاد المسلمين ما دام ذلك خاضعا للقوانين التنظيمية التي تحكم هذا وتراعي في الوقت ذاته المصلحة العامة من عدم الإضرار بالغير واعتبار النسبة العددية التي تبنى لأجلها هذه الكنائس.

The research aims to express the verdict of congratulating the People of the Book during their holidays. It also aims to clarify the opinion of Ibn Taymiyya in the verdict of congratulating the People of the Book because of the views that are raised based on Ibn Taymiyyah in this matter. The research followed the extrapolating approach that tracks the opinions of scholars from their original standpoints. It also followed the analytical and empirical approach in showing the existence of the meanings of texts from the Book and the Year, the origins of these issues, and the impact of different times and returns on them. The research also followed the comparative approach in explaining the difference of scholars in the issues in question, such as in congratulating the People of the Book on their holidays, and building churches- two issues where the details of the Word, God willing, are the Almighty-. One of the most important results of this research was that it is permissible to convert a non-Muslim and accept his gift in the absence of what Islam prohibits his eye from being eaten like wine and pig. Islam does not prohibit non-Muslims from congratulating them on their holidays in accordance with the provisions contained in dealing with them in righteousness and charity. There is also no objection to building churches in Islam as long as this is subject to the organizational laws that govern this, while at the same time taking into account the public interest not to harm others and considering the number for which these churches are built.
