|a تناول هذا البحث بيان مدى المسؤولية القانونية للمهندس والمقاول في ضمان متانة البناء في التشريع الأردني المقارن، واتبع الباحث في دراسة موضوع البحث أكثر من منهج بحثي هم: المنهج الوصفي والمنهج التحليلي والمنهج المقارن. وقد تبين من خلال البحث أنّ المشرع الأردني اعتبر مسؤولية كل من المقاول والمهندس من النظام العام بحيث يكون كل من المقاول والمهندس متضامنين في الضمان، وقد حدد المشرعين الأردني والمصري مدة هذا الضمان بعشر سنوات تبدأ من وقت تسليم العمل، كما تبين أن الضمان العشري بحق كل من المقاول والمهندس المعماري لا تنتفي إلا في حال وجود السبب الأجنبي كالقوة القاهرة مثلاً. وأوصت الدراسة في الختام أن يقوم المشرع الأردني بتوسيع دائرة الحماية بالنسبة لهذه المسؤولية واستحداث ضمانات أخرى غير الضمان العشري، وبإخضاع كل من ساهم في عملية البناء لأحكام المسؤولية الخاصة أسوة بالمشرع الفرنسي، كذلك أن يقوم المشرع الأردني بزيادة مدة الضمان وذلك في الأعمال الكبيرة والمشاريع الضخمة التي تحتاج لوقت أكبر للكشف عن عيوب قد تهدد متانة البناء وسلامته
|b This research dealt with the statement of the extent of the legal responsibility of the engineer and the contractor in ensuring the durability of the building in the comparative Jordanian legislation. It was found through the research that the Jordanian legislator considered the responsibility of both the contractor and the engineer to be part of the public order so that both the contractor and the engineer are jointly liable in the guarantee. From the contractor and the architect, it is not negated unless there is a foreign reason such as force majeure, for example. In conclusion, the study recommended that the Jordanian legislator expand the protection circle for this responsibility and introduce guarantees other than the decimal guarantee, and subject everyone who participated in the construction process to the provisions of special responsibility, similar to the French legislator, as well as that the Jordanian legislator increase the guarantee period in large works and mega projects that You need more time to detect defects that may threaten the durability and safety of the construction.
