المستخلص: إن منح سلطة لرئيس الجمهورية بدون مسؤولية أمر لا يحقق مبدأ العدالة، كما أن المسؤولية دون سلطة ينافيها أيضا، وبقدر وجود السلطة لابد أن توجد مسؤولية المناسبة والمتناسبة للسلطة وبدون المسؤولية سيرتب شعور بعدم المحاسبة لأعمال والتصرفات التي يقوم بها، لذا فأن تحقيق التلازم بـين السلطة الممنوحة لرئيس الجمهورية والمسؤولية قد لا يكفى لتحقيق العدالة وإنما يلزم أن يتحقق التعادل والتناسب بينهما، فعلى قدر ما يمنح من سلطات في الدستور والقوانين تكون عليه التزامات يترتب عند الإخلال بها مسألته، وهذا يعنى وجوب بقدر منح رئيس الجمهورية من السلطات لإنجاز الأعمال المكلف بها القدر الضروري من المسؤولية، فـاذا كانت السلطة الممنوحة له دون القدر الضروري من المسؤولية لأدى ذلـك إلى العجز أو التقصير عن تحقيق الأهداف التي منح لها سلطة لإنجازها. كما أن مساءلة رئيس الجمهورية يجب أن توضع بالشكل الذي يضمن عدم استخدامها لتأخيره عن أداء مهامه أو لاستخدامها لأغراض القصد منها الحصول على منافع شخصية، كما يجب أن يخضع رئيس الجمهورية للمسؤولية عند ارتكابه مخالفة التزاماته الدستورية وبشكل متعمد للمحاكمة أمام جهة قضائية مختصة.

Granting authority to the President of the Republic without responsibility is not something that does not achieve the principle of justice, just as responsibility without authority also contradicts it, and to the extent that the authority exists, there must be appropriate and proportionate responsibility for authority and without responsibility. The Republic and responsibility may not be sufficient to achieve justice, but it is necessary to achieve parity and proportionality between them, for in so far as it is granted powers in the constitution and laws, it has obligations that, upon breach of it, entail its issue، This means that the President of the Republic must be granted from the authorities to complete the tasks assigned to him with the necessary amount of responsibility, if the authority granted to him is without the necessary amount of responsibility, then this would lead to incapacity or failure to achieve the goals that he was given authority to accomplish. Justice in the accountability of the President of the Republic must be placed in a manner that ensures that it is not used to delay him from performing his duties or to use it for purposes intended to obtain personal benefits, and the President of the Republic must be held accountable when committing a breach of his constitutional obligations and intentionally being tried by a competent judicial authority.
