|a أصبحت القواعد التقليدية غير كافية في الوقت الحاضر لغرض مواكبة التطور الحاصل في المجتمعات، لذا لابد من تطور يقابله خاصة عندما نجد طرفا لديه القدرات المعرفية والفنية المتعلقة بمحل العقد، يقابله طرف أخر يفتقر لهذه البيانات، ولقد بينت هذه الدراسة أن نزاهة المحل تتحقق عندما يلتزم المتعاقد بالإفضاء عن جميع المعلومات المتعلقة بالمحل للمتعاقد معه، كما بينت هذه الدراسة أن نزاهة محل عقد بيع الأشياء المستقبلية تتحقق بخلو محله من الغرر، وعليه فإن نزاهة محل العقد تدور وجودا وعدما مع الغرر.
