المستخلص: يهدف هذا البحث إلى بيان دور الاجتهاد المقاصدي في معالجة مستجدات، ونوازل القضايا الفقهية المتعلقة بالعبادات، بجعل المقاصد الشرعية وسيلة للاجتهاد؛ لمعرفة أحكام المستجدات والنوازل التي لم ينص على حكمها، أو يجمع عليها، ولما كانت نصوص الوحي ثابتة محصورة والوقائع، والحوادث متجددة ومتوالية؛ فكان لابد من الحاجة إلى الاجتهاد. وتعد مقاصد الشريعة من أهم ما يسدد عملية الاجتهاد في البحث عن الأحكام، فهي إحدى الركائز التي يستند إليها المجتهدون في معرفة أحكام المستجدات، والنوازل، وهي خير أداة لتوسيع مجال الاجتهاد القادر على استنباط الحلول، للوقائع المتجددة، والمسائل النازلة، مما يبرز حيوية الشريعة وصلاحيتها للتطبيق، والعمل بها في كل زمان ومكان، ومواكبة حركة التطور، والنمو، والتغيير في كافة المجالات. وقد اشتمل هذا البحث على: مبحثين تسبقهما مقدمة، وتمهيد، وتقفوها خاتمة، أما المقدمة فاشتملت على: الحمد لله والثناء عليه عز وجل، والصلاة على نبينا الكريم، وأهمية الموضوع، وخطة البحث، والمنهج المتبع فيه. والتمهيد: في تعريف مقاصد الشريعة، وأما المبحث الأول: في الاجتهاد المقاصدي وقد تناولت فيه: تعريف الاجتهاد المقاصدي، مجالاته،، وضوابطه، وشروطه، وأهميته، ثم مراحل الاجتهاد المقاصدي في تنزيل الأحكام، وأما المبحث الثاني: فيتضمن أثر الاجتهاد المقاصدي في الفروع الفقهية المعاصرة المتعلقة بالعبادات، ثم كانت خاتمة البحث رصدت فيها أهم النتائج، وكان من أهم النتائج ضرورة اهتمام العلماء والباحثين بموضوع الاجتهاد المقاصدي في العصر الحاضر، لإدراك الأحكام في كل المستجدات والنوازل التي لم يرد فيها نص قاطع، ومراعاة الاجتهاد المقاصدي وفهم الواقع الذي يتنزل عليه الحكم الشرعي، واعتبار مآل الاجتهاد، والتنزيل، دور الاجتهاد المقاصدي في معالجة حوادث، ومستجدات العصر.

This research To clarify the role of objective ijtihad in addressing developments and calamities of jurisprudential issues related to worship, by making legitimate objectives a means of ijtihad; To know the rulings of new developments and calamities whose rulings were not stipulated or agreed upon, and since the texts of revelation are fixed and limited and facts and events are continuous and continuous; It was necessary to diligence. The purposes of Sharia are one of the most important things that advance the process of ijtihad in the search for rulings, as it is one of the pillars upon which the mujtahids rely in knowing the rulings of new developments and calamities, and it is the best tool for expanding the field of ijtihad that is able to devise solutions to the renewed facts and emerging issues, which highlights the vitality and validity of the shari’a. To apply and work in every time and place, and to keep pace with the movement of development, growth, and change in all fields. This research included: two topics preceded by an introduction and a preface, and followed by a conclusion. And the preamble: in defining the purposes of Sharia, and as for the first topic: in the intentional ijtihad, in which I dealt with: the definition of intentional ijtihad, its fields, its controls, conditions, and its importance, then the stages of intentional ijtihad in the revelation of ruling , then was the conclusion of the research in which the most important results were noted, and one of the most important results was the need for scholars and researchers to pay attention to the subject of intentional ijtihad in the present era, in order to understand the rulings in all developments and calamities in which no definitive text was mentioned, taking into account the intentional ijtihad and understanding the reality on which the legal ruling descends, and considering The fate of diligence, download, the role of intentional diligence in dealing with accidents, and developments of the age.
