المستخلص: هدفت الدراسة إلى إبراز الانتهاكات الإسرائيلية للحقوق الصحية لسكان قطاع غزة أثناء عدوان 2021، والبحث في آليات المسؤولية الدولية الممكنة والمفترضة المترتبة على العدوان. خرجت الدراسة بعدة نتائج أهمها، أن سلطات الاحتلال الإسرائيلي تتحمل المسؤولية الدولية عن انتهاكاتها لقواعد القانون الدولي العام وقواعد القانون الإنساني، وإمكانية تحريك المسؤولية الدولية ضد إسرائيل أمام محكمة العدل الدولية عن جريمة الإبادة الجماعية شرط أن تقبل (فلسطين) باختصاص المحكمة، فضلا عن إمكانية تحريك المسؤولية الدولية ضد إسرائيل أمام المحكمة الجنائية الدولية بعد قبول (فلسطين) فعلا باختصاص المحكمة، كما توصلت الدراسة إلى إمكانية تحريك المسؤولية الدولية ضد إسرائيل أمام (دولة ثالثة) وفقا للاختصاص القضائي العالمي. في ضوء نتائج الدراسة، طالب الباحثان الأمم المتحدة بتحمل مسؤولياتها القانونية تجاه حماية الحقوق الصحية للفلسطينيين، كما طالبا المدعي العام في المحكمة الجنائية الدولية بتحمل مسؤولياته القانونية والأخلاقية، باستكمال التحقيقات في انتهاكات سلطات الاحتلال الإسرائيلي وتحريك المسؤولية الدولية أمام المحكمة، بالإضافة لمطالبتهما المجتمع الدولي بتحمل مسؤولياته القانونية والأخلاقية، والعمل الجاد على الانتصاف للضحايا الفلسطينيين من خلال تفعيل أدوات المساءلة والمحاسبة الدولية لمرتكبي الجرائم من الإسرائيليين وفقا للاختصاص القضائي العالمي.

The study aimed to highlight the Israeli violations of the health rights of the residents of the Gaza Strip during the 2021 aggression, and to investigate the mechanisms of possible and assumed international responsibility resulting from the aggression. The study came out with several results, the most important of which is that the Israeli occupation authorities bear international responsibility for their violations of the rules of general international law and the rules of humanitarian law, And the possibility of moving international responsibility against Israel before the International Court of Justice for the crime of genocide, provided that (Palestine) accepts the jurisdiction of the court, as well as the possibility of moving international responsibility against Israel before the International Criminal Court after (Palestine) actually accepts the jurisdiction of the court, and the study also found the possibility of moving International responsibility against Israel before (a third country) according to the international jurisdiction. In light of the results of the study, the researchers called on the United Nations to assume its legal responsibilities towards protecting the health rights of the Palestinians, they also demanded the Prosecutor of the International Criminal Court to assume his legal and moral responsibilities, by completing investigations into the violations of the Israeli occupation authorities and bringing international responsibility before the Court, In addition to their call on the international community to shoulder its legal and moral responsibilities, and to work hard to obtain redress for the Palestinian victims by activating the tools of accountability and international accountability for the Israeli perpetrators of crimes in accordance with the international jurisdiction.
