|b The announcement by the United States Supreme Court of its decision to renounce the constitutional precedent of Roe v. Wade, which guarantees women's right to abortion under specific regulations and restrictions, has provoked criticism in American society, calling it a violation of women's most important rights. Accordingly, the present paper aims to demonstrate the legitimacy of the Court's failure to formulate constitutional principles and interpretations formulated in the past and its implications for fundamental rights and freedoms. The most important finding was that the Court's renunciation of its constitutional precedents was legitimate for as long as it was intended to protect constitutional legitimacy and safeguard fundamental rights and freedoms.
