|a النظر العقلي، خاصية أساسية يقوم عليها المنهج الأصولي عند الشاطبي، وهي ميزة تظهر في كل مراحل المنهج الذي اعتمده في استنباط الأحكام الشرعية من أدلتها التفصيلية، سواء تعلق الآمر بتصنيف الأدلة وترتيبها، أو التمييز بينها من حيث القيمة الاستدلالية، أو تعلق الآمر بالترجيح بين الأدلة المتعارضة، الأمر الذي جعل من المنهج الأصولي لديه، أداة ذات أهمية لا لتطبيق الأحكام الشرعية فقط، بل وسيلة أيضا لإصلاح علم أصول الفقه، من أجل أن يشمل بشكل أوسع النظر العقلي، وأن يمتلك العاملون في هذا المجال، القدرة على استنباط الأحكام الشرعية بالشكل الصحيح، والأكثر من ذلك الفطنة في إسقاطها على ما يتناسب معها من حوادث في الواقع، حتى يكون هذا العلم أداة معينة للشارع، لا سببا في الاختلاف. ولن تتحقق تلك الغاية من دون اجتهاد، وكل اجتهاد محمود حسب الشاطبي، فإما أن يصيب صاحبه فله أجران، وإما أن يخطئ فله أجر الاجتهاد، وذلك كله لأجل إصلاح حال الأمة في عهد كثرت فيه الصراعات وانتشرت فيه الفتن.
|b Intellectual consideration is a basic characteristic on which Al-Shatibi’s fundamentalist approach is based on, a feature that appears in all stages of the approach he adopted in deriving Sharia rulings from their detailed evidence, whether it is a matter of classifying and arranging the evidence, or distinguishing between them in terms of inferential value, or it is related to the prioritizing between conflicting evidence, which made the fundamentalist approach to him an important tool not only for the application of Sharia rulings, but also as a means for reforming the principles of Islamic jurisprudence, in order to include more broadly rational consideration, and for those working in this field to have the ability to derive Sharia rulings in the correct manner, and more than that, to be clever in dropping them on what corresponds to them in terms of incidents in reality, so that this knowledge becomes a specific tool for the lawgiver, not a reason for disagreement. An end will not be achieved without diligence, all which is praiseworthy according to Al-Shatibi. If he is right, he has two rewards, if he errs, he has the reward of diligence, and all of this is for the sake of reforming the nation in an era in which conflicts abounded and strife spread.
