المستخلص: الحمد لله وحده، والصلاة والسلام على من لا نبي بعده... وبعد: فقد شهد العالم بأسره تقدما تكنولوجيا في شتى مناحي الحياة، إيجابا وسلبا، وكان من أهم منتجات هذا التقدم التكنولوجي ما يسمى بالمخدرات الرقمية؛ لذا آثرت أن أكتب بحثا حول هذه النازلة الفقهية، ووسمته ب "المخدرات الرقمية ومدى مشروعية استخدامها، دراسة فقهية مقارنة"؛ قاصدا بذلك بيان حقيقتها، ووجودها، وتكييفها الفقهي، وحكم تعاطيها في الفقه الإسلامي. وقد قسمت هذا البحث إلى مقدمة، وثلاثة مباحث، وخاتمة، وهي كما يلي: أما المقدمة: ذكرت فيها أهمية موضوع البحث، وإشكالياته، وأهم الدراسات السابقة، والمنهج المتبع في كتابته، وخطة البحث. وأما المبحث الأول: تكلمت فيه عن تعريف المخدرات الرقمية، والفرق بينها وبين المخدرات التقليدية، ونشأة المخدرات الرقمية وتطورها، وأسباب تعاطيها وآثاره. وأما المبحث الثاني: تكلمت فيه عن التكييف الفقهي للمخدرات الرقمية سواء تم تخريجها على المخدرات التقليدية أو على المعازف والموسيقى، مع بيان رأي الباحث في هذه المسألة. وأما المبحث الثالث: بينت فيه الحكم الفقهي للمخدرات الرقمية ومدى مشروعية استخدامها، سواء كان ذلك على سبيل الإدمان أو التداوي، مع ذكر آراء العلماء، وأدلتهم، ومناقشتها، والرأي الراجح. وأما الخاتمة: فقد ذكرت فيها أهم النتائج والتوصيات التي توصلت إليها، فكان من أهم النتائج: وجود المخدرات الرقمية وتكييفها فقهيا على المعازف والموسيقى وإن كانت آثارهما مختلفة، وأن الأصل عدم جواز تعاطيها إلا على سبيل التداوي، بشرط: أن لا يتعين الشفاء إلا بها، وأن يصفها طبيب مسلم ثقة، وأن لا يترتب على استخدامها ضرر أكبر من الضرر الموجود. ومن أهم التوصيات: استصدار قانون يجرم صناعة المخدرات الرقمية وتداولها وتعاطيها، الاهتمام بالجانب التوعوي بخطورة المخدرات الرقمية على الأفراد والمجتمعات، عقد المؤتمرات والندوات مع مشاركة جميع المتخصصين من علماء الدين والطب والاجتماع وغيرها؛ لمعالجة هذا الخطر الداهم على بيوتنا جميعا.

Praise be to God alone, and prayers and peace be upon the one after whom there will be no prophet... And yet: The entire world has witnessed technological progress in various aspects of life, positively and negatively, and one of the most important products of this technological progress was what is called digital drugs; Therefore, I chose to write a research on this jurisprudential issue, and labeled it "digital drugs and the legality of their use, a comparative jurisprudential study"; Intending to clarify its reality, its existence, its jurisprudential adaptation, and the ruling on its use in Islamic jurisprudence. This research was divided into an introduction, three topics, and a conclusion, which are as follows: As for the introduction: I mentioned the importance of the research topic, its problems, the most important previous studies, the approach followed in writing it, and the research plan. As for the first topic: I talked about the definition of digital drugs, the difference between them and traditional drugs, the emergence and development of digital drugs, and the causes and effects of their abuse. As for the second topic: I talked about the jurisprudential conditioning of digital drugs, whether they are extracted on traditional drugs or on musicians and music, with a statement of the researcher's opinion on this issue. As for the third topic: I explained the jurisprudential ruling on digital drugs and the extent of their legality, whether it is as a way of addiction or medication, with mentioning the opinions of scholars, their evidence, and discussing them, and the most correct opinion. As for the conclusion: I mentioned in it the most important findings and recommendations that I reached, and one of the most important results was: the existence of digital drugs and their jurisprudential adaptation to musicians and music, even if their effects are different, and that the principle is that it is not permissible to use them except as a means of medication, provided: that it is not necessary to cure without it, It should be prescribed by a trustworthy Muslim doctor, and that its use should not result in more harm than the existing harm. Among the most important recommendations: issuing a law criminalizing the manufacture, circulation and abuse of digital drugs, paying attention to the awareness aspect of the danger of digital drugs to individuals and societies, holding conferences and seminars with the participation of all specialists from religious, medical, social and other scholars; To address this imminent danger to all of our homes.
