إن متابعة المقاولة لنشاطها عن طريق تنفيذ مخطط الاستمرارية فهذا رهين بضرورة مواصلة تنفيذ العقود الجارية على أساس أن العقد يشكل أحد أصول المقاولة ومالا من أموالها، وبالتالي لا يمكن فصله أو ترك تقرير مصيره لطرفيه مادام أحدهما خاضع لمسطرة التسوية القضائية، ما دام يمكن الاستفادة منه.
