استهدف هذا البحث إبراز الطرق الشرعية؛ لتوثيق الدين، بكتابته والإشهاد عليه وأخذ الرهن في مقابله، وكذا الأحكام التي تتخلل كل طريقة من هذه الطرق، وذلك في ضوء الآيتين (282 - 283) من سورة البقرة. ويشمل هذا البحث مقدمة وثلاثة مباحث، تناول المبحث الأول منه؛ تعريف الدين وأقسامه وأسباب ثبوته، وتناول المبحث الثاني؛ معنى التوثيق وحكمة مشروعيته، في حين تحدث المبحث الثالث بالتفصيل عن طرق توثيق الدين التي ذكرتها الآيتان الكريمتان بالكتابة والشهادة والرهن وأحكام كل منها. ثم انتهى البحث بخاتمة؛ تضمنت النتائج التي توصل إليها، والتي كان من أهمها: - أن الشريعة الإسلامية أولت موضوع الدين والتداين بين الناس أهمية كبيرة، ووضعت طرقا ووسائل لتوثيقه؛ حفظا للمال، ومنعا للنزاع. - طرق توثيق الدين التي وردت في الآيتين 282-283 من سور البقرة، هي الكتابة والإشهاد والرهن. - هناك أسباب متعددة لثبوت الدين في الذمة. -طرق توثيق الدين منها ما هو ثبوتي كالكتابة، ومنها ما هو استيفائي كالرهن. - توثيق الدين بالكتابة والإشهاد والرهن مندوب إليه وليس واجبا، والأوامر التي تضمنتها آية الدين والآية التي تلتها من سورة البقرة كانت فقط للندب والإرشاد للصلاح.
This research aimed to highlight the legal methods of documenting the debt, by writing it, attesting it, and taking the mortgage in return, as well as the provisions that permeate each of these methods, in light of the two noble verses (282- 283) of Surat Al-Baqarah. This research includes an introduction and three chapters, the first of which deals with; definition of religion, its divisions and reasons for its proof, and discussing the second topic; the meaning of documentation and the wisdom of its legitimacy, while the third topic talked in detail about the ways of documenting the debt mentioned by the two noble verses in writing, testimony, mortgage and the provisions of each. Then the research ended with a conclusion; Tire research findings included, the most important of which were: - Tire Islamic Sharia gave great importance to the issue of religion and piety among people, and developed ways and means to document it, in order to preserve money and prevent conflict.. - The ways of documenting the debt that are mentioned in verses 282 and 283 of Surat Al-Baqarah, are writing, witnessing and mortgaging. - There are several reasons for establishing a debt as a liability. - Methods of documenting the debt, some of which are definitive, such as writing, and some that are fulfillment, such as a mortgage. Documenting the debt by writing and attesting, and mortgage is delegated and not obligatory, and the commands included in the verse of religion and the verse that followed it from Surat Al-Baqarah were only for advice and guidance for righteous.
