المستخلص: يدرس هذا البحث النتائج المترتبة عن إخلال البائع بتنفيذ الضمان، ويهدف إلى بيان مدلول الضمان والحكمة منه في التشريع الجزائري، وكذا بيان مدى إلزامية تنفيذ الضمان من طرف البائع، كما يهدف إلى ذكر نتائج عدم التزام البائع بالضمان، وتحديد حقوق المشتري عند عدم تنفيذ البائع لما جاء في الضمان، ومن أهم نتائج البحث أنّ الضمان آلية من آليات حماية المستهلك؛ يفرضه المشرع في بعض عمليات البيع، وهو التزام البائع أو المنتج بتنفيذ جملة من خدمات الصيانة أو الإصلاح أو الاستبدال إذا ظهر عيب في المبيع خلال فترة معينة، وإذا توفرت شروط الالتزام بتنفيذ الضمان، ولم يلتزم البائع بها فإنه يلُزم بذلك قضائيا أو يتحمل الغرامة المنصوص عليها، كما أنّ عدم تنفيذه للضمان يعطي للمشتري الحق في طلب التعويض أو الفسخ.

This research studies the consequences of the seller's breach of guarantee implementation. It aims to explain the meaning of the guarantee and the wisdom thereof in the Algerian legislation, as well as an indication of the obligatory performance of the guarantee by the seller. It also aims to mention the consequences of the seller's non-compliance with the guarantee, and to determine the rights of the buyer when the seller does not implement the guarantee. Among the most important results of the research is that guarantee is a means consumer protection; imposed by the legislature in some sales. It is the obligation of the seller or producer to implementation of some maintenance, repair or replacement services if a defect appears in the product during a certain period. In addition, if the conditions for the obligation to implement the guarantee met, and the seller does not comply with them, he is obligated by the judiciary, or bears the stipulated fine; also, failure to implement the guarantee gives the buyer the right to request compensation or annulment.
