المستخلص: إن الانتفاع بما حققته البشرية من تقدم علمي لا تمنعه الشرعة الإسلامية؛ إذا حقق مقاصدها وسار في فلكها، وهذا لا شك يعطي لأحكام الشرعة صفة البقاء والخلود مهما تغيرت الظروف وتبدلت الأحوال، وهذا الكمال التشريعي الذي تميزت به تعاليم الإسلام هو غاية في الإعجاز الرباني، الذي يقيم الحياة الإنسانية على أفضل صورة وأرقى مثال، في عصر تميز بالتطور التقني المذهل، والتقدم العلمي السريع، في جميع شئون الحياة. وموضوع البحث (الآثار الفقهية للتقدم التقني على مسائل الأحوال الشخصية) يقوم بسد الفراغ الذي يحيط بموضوعه، ويساهم في حل المنازعات الناتجة عن بعض التقنيات المعاصرة المندرجة بمضمونه، على أساس شرعي يظهر من خلاله روح التجديد المنضبط بإثراء حركة الاجتهاد في الفقه الإسلامي، وترسيخ مرونته بطريقة قائمة على الحجة والبرهان، بما يواكب حال الناس، ويحقق مصالحهم في ضوء قوعد الشريعة ومقاصدها، ومعطيات العصر ومتطلباته، كما يعمل على إيجاد حلول للقضايا والنوازل التي تتصل بدنيا الناس، وتحدث منهم وبينهم، وبخاصة بعض المسائل التي تتداخل أسبابها وتتشابك موضوعاتها، ونتعدد صورها وتتعارض مصالحها.

The topic of the research fills the gap that surrounds the issue of the marriage and divorce occurrence and what is related to them electronically through contemporary communication techniques in the light of the provisions of law Sharia, It also contributes in solving the disputes arising from them technically, it has been also characterized by originality, seriousness and depth, in addition to its objectivity and impartiality; so as to be an indispensable reference that paves the way for deciding emerging issues in people’s lives, on a legitimate basis through which the spirit of disciplined renewal emerges by enriching the movement of ijtihad in Islamic thought, and consolidating the flexibility of Islamic law, and participating in a dialogue based on argument and proof in a way that keeps pace with the situation of people, and achieves their interests in the light of the rules of Islamic jurisprudence, the purposes of Sharia, and the current data and requirements. The topic of the research is also related to the jurisprudence of reality, and it works to renew the jurisprudence of personal status in light of its constants and principles. He works to find solutions to issues and calamities that relate to people's world and occur between them and between them, especially some calamities whose causes overlap, their themes are intertwined, their forms are multiple and their interests conflict. Moreover, it supplies the Islamic library with something new in terms of rooting. since the collection of such new and multiple issues, that involved in the topic of research, contribute to an edifice building of contemporary personal status issues, taking into account that the topic is also characterized by modernity, and deals with issues of reality, that are desired to be obtained in contemporary legal writings.
