المستخلص: إن نصوص الأحكام في القرآن الكريم والسنة النبوية الشريفة، وردت فيها ألفاظ كثيرة، منها النص والظاهر، فالنص هو ما لا يحتمل التأويل والظاهر هو ما يحتمل التأويل، فالأصل في أدلة الأحكام الشرعية إجراؤها على ظواهرها إلا إذا وجد دليل يدل على صرف اللفظ عن ظاهره وهذا معنى التأويل، ولذا هدفت الورقة إلى الوقوف على التأويل الصحيح والفاسد عند الأصوليين، اتبعت الورقة المنهج الاستقرائي والوصفي والتحليلي. توصلت الورقة إلى أن التأويل إذا كان لدليل استدعى ذلك كان التأويل صحيحا لا شيء فيه بل في بعض الحالات يصبح ضروريا أما إذا كان الدليل ضعيفا لا يظهر له وجه فهو ممتنع؛ فلا يجوز للمؤول بناء الأحكام الشرعية عليه، إن حمل النص على ظاهره أحيانا سبب من أسباب الفهم الخاطئ كما حصل للصحابة عندما حملوا كلمة الظلم على ظاهرها، التأويل معمول به إذا تحققت شروطه منذ زمن الصحابة إلى زماننا هذا من غير نكير، و كل ما ازداد النص وضوحا كان أبعد عن التأويل، إن التعارض بين النصين وعدم وصول النص إلى الفقيه سبب من أسباب التأويل. أوصت الورقة الباحثين البعد عن الأخذ بالتأويل الفاسد، ينبغي لطالب العلم السؤال في النصوص التي تحتمل التأويل ولا يأخذها على ظاهرها، على المؤول أن يتصف بصفات المجتهد؛ لأن التأويل في إطار الاجتهاد، ضرورة عدم رفض جميع التأويلات البعيدة، ورفض التأويل الباطل غير الموافق لروح الشرع.
