المستخلص: جاء نظام التنزيل في قانون الأسرة الجزائري لمعالجة حالة الأحفاد الذين يموت أبوهم أو أمهم في حياة جدهم أو جدتهم، حيث نص قانون الأسرة رقم 84-11 على تنزيلهم منزلة أصلهم في التركة بشروط معينة، غير أن تلك النصوص لم تجب على كل إشكالات التنزيل واحتوت على كثير من الغموض، وهو ما يزيد من أهمية البحث في الاجتهاد القضائي للمحكمة العليا - كونها تعمل على توحيد الاجتهاد القضائي في أنحاء البلاد، وكيفية حلها لمختلف إشكالات التنزيل، قبل صدور قانون الأسرة، أو تصديها لتفسير النصوص القانونية بعد صدور هذا القانون.

Inheritance by substitution in Algerian family law concerns the situation of grandchildren whose father or mother dies in the life of their grandfather or grandmother .Family Law provides for replacing them in their parents' place in the inheritance. But these texts did not give an answer to the problems of inheritance by substitution and included a lot of ambiguity, This makes it even more important to search for Supreme Court jurisprudence and its way of resolving the different issues of inheritance by substitution, before the publication of the family law, or his interpretation of texts after the publication of this law.

L’héritage par substitution prévu par le code de la famille algérien concerne désormais la situation des petits-fils dont le père ou la mère décède dans la vie de leur grand-père ou de leur grand-mère, Mais ces textes n’ont pas donné réponse aux problématiques de l’héritage par substitution et incluaient beaucoup d’ambiguïté, Ce qui rend encore plus importante la recherche de la jurisprudence de la Cour suprême Et sa façon de résoudre les différents problématique de l’héritage par substitution, avant la parution du code de la famille, ou son interprétation de textes juridiques après sa parution.
