المستخلص: على إثر ثبوت فشل السياسات الردعية والقمعية في مجابهة الإجرام بصفة عامة، وهذا ما هو ثابت من خلال الأرقام والإحصائيات الدالة على تزايد نسبة الإجرام داخل المجتمعات، فقد اتجهت السياسة الجنائية الحديثة إلى تبني سياسة وقائية لعلها تجدي نفعا في امتصاص هذه الظاهرة. هذا التوجه تبناه المشرع الجزائري في مجابهة العديد من الجرائم من بينها جرائم الفساد التي تعرف تغلغلا ملحوظا في المجتمع الجزائري، وذلك من خلال سياسة وقائية سنحاول التعرف على ملامحها من خلال هذا المقال.

Following the proven failure of deterrent and repressive policies to confront criminality in general, which is consistent with figures and statistics on the increasing proportion of criminality within societies, modern criminal policy has tended to adopt a preventive policy that may be useful in absorbing this phenomenon. This trend has been adopted by the Algerian legislator in the face of a number of crimes- including corruption- which are known to be a significant part of the Algerian society, through a preventive policy, which we will try to identify through this article.

En raison de l'échec des politiques dissuasives et répressives face à la criminalité en général, tel que nous le montrent les chiffres et les statistiques sur le phénomène croissant de la criminalité dans les sociétés, la politique pénale moderne a eu tendance à adopter une politique préventive dans l’espoir d’éradiquer ce phénomène. Cette tendance a été adoptée par le législateur algérien face à de nombreux crimes, y compris les délits de corruption, qui sont connus pour être une perversion importante de la société algérienne, par une politique préventive que nous essayerons d'identifier à travers cet article.
