المستخلص: يشهد العالم اليوم كثيرا من المشاكل والنزاعات التي تحدث بين دوله وأفراده ومجتمعاته، ومن أشهر هذه النزاعات ما يكون بسبب الماء ومصادر الشرب، فبدونه تتوقف الحياة، وبوجوده تحيى وتزدهر، وقد أولى الشرع الحكيم العناية التامة به من نواحي كثيرة، ومنها ما يتعلق بما لو وقع نزاع بسببه، وقد وردت علاجات كثيرة وقائية وعلاجية، وازدهرت بها السنة النبوية، ومن خلالها ذلك جاء هذا البحث ليقرر بالأمثلة والنصوص النبوية المباركة هذا الأمر، وقد جاء في مقدمة وثلاثة مباحث؛ كان الأول منها في التعريف بالنزاع المائي، وبيان دواعيه وأسبابه، وقد احتوى على مطلبين في التعريف بمصطلح النزاع وفي دواعيه وأسبابه. وأما المبحث الثاني ففي علاج النزاعات المائية في السنة النبوية المطهرة، وقد جاء في مطلبين الأول منهما في الدعوة إلى مكارم الأخلاق، ونبذ مساوئها قبل النزاع وبعده، ثم في أهمية الصلح بين المتنازعين، وأما المبحث الثالث ففي معرفة أحكام الشريعة في حق التملك والانتفاع في المياه، وجاء على ثلاثة مطالب هي: إقرار مبدأ الشراكة في الحقوق المائية، وتحديد من هو الأولى بالماء ومراعاة حق الآخرين، ثم في المحافظة على الثروة المائية، ومحاولة استثمارها للجميع، وفي الخاتمة توصل الباحث إلى عدة نتائج منها تحرير مصطلح النزاع، والتحقيق في أن أكثر أسباب النزاع المائي هو الظلم والبغي على الآخرين، ومدى معالجة الشريعة لذلك والمتمثلة في القرآن الكريم والأحاديث النبوية الكثيرة التي اشتملت على التدابير الوقائية والعلاجية التي تختص بالنزاعات المائية. وقد أوصى الباحث في نهاية بحثه إلى ضرو العناية بمثل هذه الدارسات والموضوعات، والتحذير من الخطر القادم في المستقبل بسببها، مع ضرو المعرفة والثقافة التامة في ذلك

The world today is witnessing many problems and conflicts that occur between its countries, individuals and societies, and the most famous of these conflicts is because of water and sources of drinking, without it life stops, and with its presence live and prosper, and the wise Sharia has given full care of it in many respects, including what relates to what if a conflict occurred because of it, and many preventive and curative treatments have been received, and the Sunnah of the Prophet flourished, and through which this research came to decide with examples and blessed prophetic texts This matter was mentioned in an introduction and three sections, the first of which was in the definition of the water conflict, and the statement of its causes and causes, and it contained two requirements in the definition of the term conflict and its causes and causes. The second topic in the treatment of water disputes in the Sunnah of the Prophet purified, has come in two requirements, the first of them in the call to noble morals, and renounce the disadvantages before and after the conflict, and then in the importance of reconciliation between the disputants, The third section in the knowledge of the provisions of Sharia in the right to own and use in water, and came on three demands: the adoption of the principle of partnership in water rights, and determine who is the first with water and take into account the right of others, then in the preservation of water wealth, and try to invest it for all, and in conclusion the researcher reached several results, including the liberation of the term dispute, and investigate that more causes of water conflict is injustice and prostitution on others, and the extent to which Sharia addresses it and represented In the Holy Qur'an and the many hadiths of the Prophet that included preventive and curative measures related to water disputes. The researcher recommended at the end of his research to the need to take care of such studies and topics, and to warn of the next danger in the future because of them, with the need for full knowledge and culture in that.
