المستخلص: تحاول هذه الدراسة بيان الأوصاف النبوية ومقاماته الدينية والدنيوية، بغية تصنيف ما صدر عنه صلى الله عليه وسلم من السنة التشريعية وغير التشريعية، لما لهذا التصنيف من دور حيوي ومهم في جميع جوانب التشريع، وقد يترتب أخطاء جسيمة بسبب الاختلاط بين هذه التصرفات؛ وذلك بتعميم ما لم يرد منه العموم، أو تخصيص ما كان عاماً، أو استنباط الحكم من نصوص غير تشريعية. كما أن هذا الاختلاط يؤدي إلى اضطراب وتعارض في المنظومة التشريعية ولا يمكن رفعه إلا بهذا التصنيف، لأن دعوى النسخ بينها غير رافعة للتعارض، بل رافعة لحكم شرعي، ودعوى نسخ نص شرعي ورفع حكمه بالظن من المعضلات الكبيرة التي لابد من إعادة النظر فيها. وعليه فإن هذا البحث يحاول بيان هذه الأمور المهمة من خلال مبحثين أولهما: لتأصيل التمييز بين التصرفات والمقامات النبوية من القرآن والسنة وأقوال الصحابة وجهود العلماء، وثانيهما لبيان أثر تنوع التصرفات النبوية في استنباط الأحكام ودرء التعارض.

This study attempts to clarify the prophetic descriptions and positions with its religious and worldly stations, in order to classify what was issued by him, peace and blessings of God be upon him, from the legislative and non-legislative Sunnah, because this classification has a vital and important role in all aspects of legislation, and serious errors may result due to the mixing of these actions; And that is by generalizing what is originally not came as a general, or specifying what was general, or deducing the ruling from non-legislative texts.In addition, this mixing leads to confusion and conflict in the legislative system, which it can only be raised with this classification, because the claim of abrogation between them does not raise the contradiction, but it raises a legal ruling. The claim of abrogating a legal text and raising its ruling by suspicion is one of the major dilemmas that must be reconsidered. Accordingly, this research attempts to clarify these important matters through two sections, the first of which is to establish the distinction between the actions and positions of the Prophet from the Qur'an and Sunnah, the sayings of the Companions and the efforts of scholars, and the second is to show the impact of the diversity of prophetic behaviours in deriving rulings and warding off contradictions.
