|a تهدف الدراسة إلى تبيان أن التاجر إذا استغرقت الديون أمواله وتعرض لشهر إفلاسه، فإذا حكم بشهر إفلاسه فقد تعرض للإفلاس، وترتب على ذلك آثار عديدة، تتعلق بالدائنين وبالمفلس المدين، ومن أهم الآثار المتعلقة بالمفلس سقوط اعتباره التجاري، وحرمانه من بعض الحقوق التي كان ينعم بها قبل شهر إفلاسه. الخروج من مآزق الإفلاس لا يتحقق إلا برد الاعتبار للتاجر حتى يعود إلى تجارته لسابقة حرا طليقا من هذه القيود الجزائية؛ ليسهم في بناء اقتصاد وطنه مع غيره من التجار. لذلك فإن رد الاعتبار التجاري له من الأهمية، من حيث إعادة الاعتبار للتاجر الذي أشهر إفلاسه وهذا البحث سوف يسلط الضوء الكاشف على هذا الموضوع، من خلال استقراء النصوص القانونية واستجلاء المواد القانونية المتعلقة بأحكامه.

Exiting the redicaments of bankruptcy can only be achieved by rehabilitating the merchant. Until he returns to his previous trade, free from these penal restrictions; To ontribute to building the economy of his country with other traders. Therefore, the commercial rehabilitation is of importance, in terms of rehabilitating the merchant who kept his bankruptcy, and this research will shed light on this subject, by extrapolating the legal texts and clarifying the legal articles related to its provisions.
