المستخلص: لقد اعتبرت الشريعة الإسلامية حق الإنسان في سلامة جسمه، وضمان سلامته الجسمانية والنفسية من أهم الحقوق الشرعية السامية التي تتمتع، والتي يجب احترامها وفقا لكرامته الآدمية، وقد بينت الشريعة الغراء أن الله عز وجل خلق الإنسان وكرمه وشرفه ووضعه في مرتبة عالية بين خلقه. وقد جاءت أحكام الشريعة الإسلامية لتؤكد عدم جواز أي مساس بجسم الآدمي وصيانته من الاعتداء عليه بأي وجه حق الله عز وجل خلق للإنسان جسما ووهب له روحا تمكنه من تأدية وظائف الحياة بمختلف صورها وأقره واجب على الغير هو عدم انتهاك حرمة هذا الكيان، وجرم جميع الأفعال التي من شأنها أن تمس بالجسم أو النفس وقيد المسلم بعدم ارتكاب هذه الأفعال إلا في الإطار الشرعي لها كالقصاص. وتجمع النظم القانونية المقارنة على ضرورة توافر عدة شروط، لإباحة العمل الطبي وهذه القيود بهدف الحفاظ على سلامة جسم الإنسان وتنطبق على ممارسة الأعمال الطبية بصفة عامة، باعتبار أن جراحة تغيير الجنس بسبب عضوي أو نفسي تتطلب علاجا هرمونيا ونفسيا ثم تدخلا جراحيا على جسم المغير لجنسه. ولذلك يجب أن يقوم المشرع بوضع القوانين التي تجرم مثل هذا الفعل. لأن الشخص الذي يرغب في التغيير الجنسي هو شخص شاذ جنسيا يسعى إلى تقمص شخصية أخرى، على أن يغير خلق الله، وذلك يتمثل في عدم تقبله لنوعه وجنسه، وان ما يحدث له من تغيير هو فقط تغيير ظاهري ولا يعد تغييرا حقيقيا، وذلك يختلف عن تصحيح الجنس للشخص المخنث جنسيا حيث لا تتضح حقيقة جنسه الأمر الذي يستدعى أن يقوم بعملية تصحيح الجنس. وندعو المشرع المصري إلى المسارعة إلى وضع تنظيم تشريعي، لحظر وتجريم عمليات تغيير الجنس كما فعل المشرع الأردني، وذلك بإقرار مسئولية الفريق الطبي ومن تجرى له العملية حفاظا على النظام العام، وعلى أن يكون واضحا في هذا التشريع من الذي يحق له تصحيح جنسه، ويمنع اتخاذ التصحيح وسيلة للتغيير الجنسي، وذلك بوضع الضوابط والقيود التي تكفل ممارسته على النحو الذي يكفل عدم إجراءه في غير حالاته. ونتمنى صدور قرار من وزارة الصحة يقضى بإلزام المستشفيات والمراكز الأهلية بعدم اتخاذ أي قرار يتعلق بإجراء عملية "تصحيح الجنس" إلا بعد التنسيق مع الجهات المختصة في الوزارة، وعرض الأمر على اللجنة المختصة، حتى لا يتم اتخاذها كوسيلة لتغيير الجنس. على أن يعهد بإصدار التصاريح اللازمة لإجراء عمليات تصحيح الجنس إلى لجنة طبية، معتمدة من وزارة الصحة تشكل من أهل الخبرة في الطب، وعلم النفس، ورجال الدين وذلك تلافيا لأن تتم هذه الجراحة لأغراض غير مشروعة.

Comparative legal systems unanimously agree on the need for several conditions to be met, to allow medical work, and these restrictions aim to preserve the safety of the human body and apply to the practice of medical work in general, given that sex reassignment surgery for an organic or psychological reason requires hormonal and psychological treatment, and then surgical intervention on the body of the transgender.. Therefore, the legislator must set laws that criminalize such an act. Because the person who desires a sexual change is a homosexual person who seeks to reincarnate into another personality, provided that he changes God’s creation, and that is represented in his non-acceptance of his gender and gender, and that what happens to him of change is only an apparent change and is not considered a real change, and that differs from correcting the sex For a transsexual person, where the truth of his gender is not clear, which necessitates that he undergo a gender correction process. We call on the Egyptian legislator to quickly put in place a legislative regulation to prohibit and criminalize sex change operations, as the Jordanian legislator did, by acknowledging the responsibility of the medical team and the person who performs the operation in order to preserve public order, and that it is clear in this legislation who is entitled to correct his gender, and it is forbidden to take Correction is a means of sexual change, by setting controls and restrictions that ensure its practice in a manner that guarantees that it is not performed in other than its cases. We hope that a decision will be issued by the Ministry of Health to oblige hospitals and community centers not to take any decision related to the operation of "sex correction" except after coordination with the competent authorities in the Ministry, and submitting the matter to the competent committee, so that it is not taken as a means of changing the sex. Provided that the issuance of the necessary permits to perform sex correction operations is entrusted to a medical committee, approved by the Ministry of Health and composed of experts in medicine, psychology, and clerics, in order to avoid that this surgery is carried out for illegal purposes.
