المستخلص: يتناول موضوع البحث أحد أهم مهددات أمن واستقرار المجتمع وهو تفشي ظاهرة التسول، فعلى الرغم من الجهود الوطنية الساعية لحفظ كرامة الإنسان وتوفير سبل التكسب المشروع، إلا أن صور التسول بل وامتهانه مازالت في توسع، وباتت تهدد الأمن والسلامة المجتمعية بل وإعطاء إنطباع سلبي عن المجتمع؛ لذا كان لزاماً أن تتحرك المساعي والجهات النظامية لوضع أطر تنظم عملية انتقال الأموال بين الأفراد بطرق قانونية تحكمها الغاية والأهداف المشروعة والتي هي أولى المرتكزات الأساسية لتحقيق المصلحة العامة في المجتمع ككل. لذا يهدف البحث إلى بيان ماهية التسول والأساليب المستحدثة في إرتكابه، وتحديد الآليات التي اتخذتها الدولة في مجابهته، فضلاً عن بيان أحكام المسؤولية الجنائية في حالة ارتكاب صور التسول، وذلك بهدف وضع منظومة حماية قادرة على الحد من انتشار هذه الآفة المجتمعية. وقد توصلت الدراسة إلى عدة نتائج من بينها تعدد صور السلوك الإجرامي المرتكب والمعاقب عليه في جريمة التسول، إضافة إلى تبني عقوبات مشددة في حالة اقتران أفعال التسول بأحد الظروف المشددة كاستغلال القاصر والعود إلى الجريمة. وخرج البحث بعدد من التوصيات وكان من بينها، العمل على تكاتف كافة الجهود في مواجهة صور التسول والحد من البطالة وأسباب الفقر، كذلك توفير سبل الضمان الاجتماعي لكل فرد من الممكن أن يكون عرضة للإستغلال في التسول بحسب احتياجاته. تشديد العقوبات لكل من تسول له نفسه اتخاذ التسول كمهنة للتكسب، خاصة إذا ما اتخذ التسول ستاراً لإرتكاب جرائم أخرى كالسرقة وتعاطي المخدرات.

The topic of this research deals with one of the threats to the security and stability of society, which is the spread of the phenomenon of beggary. Despite the national efforts to preserve human dignity and provide means of legitimate earning, the images of begging and even the humiliation of beggars are still expanding. In fact, beggary threatens security and community safety and even gives a negative impression on society. Therefore, it is important to made the necessary endeavors and urge the statutory bodies to set a frameworks regulating the process of transferring funds between individuals in legal ways governed by the legitimate purpose and objectives, which are the first basic pillars to achieve the public interest in society as a whole. Therefore, the research aimed to clarify the nature of beggary and the methods developed in its perpetration, and to identify the mechanisms that the state must take in confronting it, as well as clarifying the provisions of criminal responsibility in the case of committing beggary, with the aim of developing a protection system capable of limiting the spread of this social phenomenon. The study reached several results, including identifying the multiplicity of forms of criminal behavior committed in the crime of beggary, in addition to the adoption of just penalties in the case of the association of the acts of beggary with one of the aggravating circumstances such as the exploitation of a minor and recidivism. The research came out with a number of recommendations, among them, working to join all efforts to confront the various forms of beggary, reducing unemployment and causes of poverty, as well as providing means of social security for each individual who may be vulnerable to exploitation in beggary according to his needs, deciding just penalties for anyone who takes beggary as a profession to earn money, especially if beggary is used as a cover for committing other crimes such as theft and drug abuse.
