المستخلص: إن غاية المسؤولية المدنية هي التعويض أي جبر الضرر الذي لحق المتضرر، والبحث في أساسها إنما هو تحليل موضوعي لكل أبعاده الاجتماعية والاقتصادية والمهنية للأسباب التي أدت إلى نشوء الالتزام بتعويض الضرر، إذ إن المستشفى يسأل عن الخطأ الذي يدخل في إطار تنظيم النشاطات الاستشفائية، وتسييرها بشأن إخلاله بتقديم العناية اللازمة والرعاية للمريض لجهة تقديم الأدوية والأطعمة، أما في حالة نشوب حريق ويذهب ضحيته العشرات فهنا يعد تقصيرا من إدارة المستشفى ويجعل المستشفى محل مساءلة، لكن ما هو أساس هذه المسؤولية المدنية، هل على أساس المسؤولية عن حراسة الأشياء أم على أساس تعبير للواقع الذي يحكم الأفراد من خلال المنازعات والصراعات التي تحدث في ما بينهم وإيجاد هذه المسؤولية كحلول لهذه المنازعات.
