المستخلص: يتمتع البرلمان الفرنسي كواحد من البرلمانات الأوروبية بدور مهم في مراقبة تطبيق مبدأ التبعية. ومن أجل القيام بهذه المهمة، يجوز لكل غرفة في البرلمان، عملا بالمادة 88-6 تقديم طعن موجه بواسطة الحكومة إلى محكمة العدل في الاتحاد الأوروبي لخرقها مبدأ التبعية. ومن ناحية أخرى فإن الاتحاد الأوروبي ملزم بعدم التدخل من أجل التعامل مع مسألة ما لم يصبح تدخله أكثر فائدة من تدخل البرلمان الوطني. لهذا الغرض يجب على الجمعية الوطنية ومجلس الشيوخ تنفيذ مهامهما الأوروبية من خلال إدراك أن هدف تطبيق الديمقراطية في أوروبا يتطلب مستوى عاليا من التعاون بين مؤسسات الاتحاد الأوروبي والبرلمانات الوطنية.

Le Parlement français en tant qu’un des parlements européens jouit d’un rôle non négligeable au niveau de surveiller l’application du principe de subsidiarité. Pour effectuer cette mission, chaque assemblée peut former- en application de l’Article 88-6- un recours, adressé par le Gouvernement, à la Cour de justice de l’Union européenne pour violation du principe de subsidiarité. Par contre, l’Union européenne se montre obligée de ne pas intervenir afin de traiter une question, sauf si son intervention devient plus utile que celle du parlement national. Pour cela, l’Assemblée nationale et le Séant doivent exercer leur mission européenne en prenant conscience que le but d’appliquer la démocratie en Europe demande une collaboration de haut niveau entre les institutions de l’Union européenne et les parlements nationaux.

As a member of the European parliament, the French Parliament has a vital role in monitoring the application of the subsidiarity principle. In order to carry out this function, each chamber of Parliament may, pursuant to Article 6-88, file an appeal through the Government to the Court of Justice of the European Union for its violation of the principle of subsidiarity. On the other hand, the EU is obliged not to intervene to deal with an issue unless its intervention becomes more valuable than that of the national parliament. For this purpose, the National Assembly and the Senate must carry out their European tasks by recognising that the goal of applying democracy in Europe requires a high level of cooperation between EU institutions and national parliaments.
