المستخلص: يهدف هذا البحث لإيضاح المدخل النظري الخاص بتحرير محل النزاع، وبيان تعبيرات الأصوليين عنه، ولإدراك فوائد تحرير محل النزاع في دراسة المسائل الخلافية وأهميته، وكشف خطوات الأصوليين في تحرير محل النزاع، وإبراز شروطهم لاعتبار صحة ذلك، وكذلك وضع منهجية تعين الباحث على استخراج محل النزاع من كلام الأصوليين، وذلك من خلال استخدام المنهج الاستقرائي لجمع المادة العلمية التأصيلية والتطبيقية؛ والمنهج الوصفي في تصوير المسائل التي يراد بحثها، والمنهج المقارن والتحليلي للمقابلة والتحليل بين أقوال الأصوليين في تحرير محل النزاع. وخلص البحث إلى عدة نتائج، من أهمها: أن تحرير محل النزاع يعد العنصر الأساسي في دراسة المسائل الأصولية دراسة مقارنة، وتعددت تسميات تحرير محل النزاع لدى الأصوليين، إلا أن مصطلح تحرير محل النزاع هو الأشهر استعمالا، والمسميات الأخرى تؤدي إلى المعنى نفسه، وكذلك وجود خلاف بين الأصوليين في تحرير محل النزاع في المسائل الخلافية، وسلك الأصوليون في تحرير محل النزاع مسالك متعددة منها: تحرير محل النزاع والتصريح به، تحرير النزاع بالنقل عمن سبق دون تمحيص، التلميح، وتحرير محل النزاع بواسطة السبر والتقسيم، وأيضا وضع الأصوليون شروطا يجب توافرها في المحرر -الأصولي-، أو طرقا تظهر صحة تحرير محل النزاع من عدمه، ووضعوا أيضا طرقا يمكن بها محاكمة تحرير محل النزاع.

This research aims to clarify the theoretical approach to determining the subject of dispute, and to clarify the fundamentalists’ statements about it. The study stresses to realize the benefits and importance of determining the subject of dispute by examining the controversial issues, and revealing the steps of fundamentalists in showing the subject of dispute, in order to highlight their conditions to consider the validity of this, as well as to develop a methodology that helps the researcher to extract the subject of the dispute. This can be achieved through the use of the inductive method to collect the original and applied scientific material and the descriptive approach in portraying the issues to be discussed. In addition, the researcher employed the comparative and analytical approach to the interview and analysis of the statements of the fundamentalists in determining the subject of the dispute. The research concluded with several results, the most important of which included determining the subject of the dispute, which is the main element in the study of fundamentalist issues. Several terms were given to determining the subject of dispute among the fundamentalists, however, the term determining the subject of the dispute is the most widely used, while the other terms lead to the same meaning. In addition to the existence of a dispute in determining the place of the dispute in the controversial issues. Nevertheless, those who pursued determining the subject of the dispute adopted several approaches such as: defining and declaring the subject of the dispute, determining the dispute by quoting from the foregoing without scrutiny, allusion, and the determination of the subject of the dispute by sounding and dividing. Moreover, the fundamentalists set conditions that must be met in the editor-fundamentalist-, or methods that show the validity of the determining of the subject of the dispute or not.
