المستخلص: يتناول هذا البحث أثر قضية التعريف المصطلحي في ترجمة المصطلح القانوني في المعجم المختص، وهي قضية شائكة تعاورتها المسالك النظرية والمناهج التي تستدعي هذا المكون المعجمي الرامي لتحديد الماهيات وتعيين المكافئات. لينتقل بنا النقاش من الصرامة المنهجية للمقولة الكلاسيكية الأرسطية التي حبست التعريف المصطلحي بالنموذج الموضوعي وتصبح المصطلحات قائمة اسمية فقط تحكمها المقاربة الأنوماسيولوجية للمصطلحية التقليدية المتصفة برهاب الاشتراك، إلى المرونة في التوصيف الدلالي نحو النسقية والانتظام عبر نظرية الطراز في الدلالة العرفانية. يهدف نموذج "الطراز" في نظريته الأصلية والموسعة إلى تطبيق "التشابه الأسري" لفتجنشتاين عبر آليات المجاز والاستعارة التي تتحكم في تصوراتنا وخطاطاتنا الذهنية في وصف التواتر الاستعمالي ورصد الآثار الطرازية للدلالات الهامشية النفسية في الحدود الضبابية للمقولات. ذلك ما يطمح إليه علم المصطلح الحديث الذي لطالما اتصفت نظريته الكلاسيكية بالأحادية الدلالية، فأخذ يميل نحو المعالجة الخطابية للمستعمل المختص، خاصة ما تعلق بتلك المقاربات التي تعتني بالمصطلح كوحدة إدراكية وثقافية تماشيا مع المناهج الاجتماعية والنصية في المصطلح. يصبح بذلك تفسير ظاهرة المشترك الدلالي المصطلحي عملية تمثل ذهنية للبنية الطرازية للمقولات ولها نصيب في إثراء نظرية التكافؤ والتعريف، خاصة ما طرح في الأنثربولوجيا العرفانية حول نسبية التصورات بين اللغات والثقافات.

This paper aims to persue the dilemma of terminological definition and its effects on translating legal terms in the specialized dictionnary, which considers a controversial issue widely discussed within the divergent models and theories aimed at determining the essence of things. The strict rules of the classic Aristotelian category that constrained the terminological definition with the objectivist model, have made terms only as nominal list according to traditional Terminology onomasioligical approach marked by polysemiophebia, which have moved the debate into semantic flexibility description and regularity via cognitive semantics Prototype-Theory. Wether original or idealised cognitive model (ICM), prototypical categorisation were analysed by Wittgenstein's "family resemblance" in terms of conceptual metaphor and metonomy that structure our perceptions and image schema by describing the basic use of a term and following its prototype effects that exhibit degrees toward the fuzzy and peripheral boundaries of the categories which lies in the psychological level of the mind grounded in our physical and cultural experience. This is what modern terminology aspires to take a step forward: acknowledging the existence of polysemy by describing the prototypically structured categories instead of monosemy idealism approach in terms of necessary and sufficient conditions, so it tends towards the discursive treatment of the specialist-user, especially the sociocogntive descriptive terminology that deal with term as cognitive and cultural unit as well as textual and communicative one. Thus, polysemy phenomena of legal term is lexically regular, functional, meaningful and usful it could be explained as a process of mental representation of a prototypically structured category that could enrich the skopos theory and the definition metalanguage, especially with contribution of cognitive anthropology about the relativity of perceptions between languages and cultures.
