المستخلص: اتجهت أغلب تشريعات العالم إلى تبني سياسة عقابية حديثة قائمة على أفكار حركة الدفاع الاجتماعي والتي تقوم أساسا على إصلاح المحكوم عليهم وإعادة إدماجهم في الوسط الاجتماعي، ولتحقيق هذا الغرض نصت مختلف المواثيق الدولية والقوانين الوطنية على المبادئ الأساسية للمعاملة العقابية التي تحقيق الغرض من العقاب وذلك من خلال المعاملة الإنسانية ووضع مجموعة من البرامج العلاجية والإصلاحية أثناء تنفيذ العقوبة السالبة للحرية وتقوم المعاملة الإنسانية على حفظ كرامة المحبوس أثناء التنفيذ العقابي ذلك من خلال حظر استخدام القسوة ضد المحبوسين وتوفير الرعاية الصحية اللازمة سواء الوقائية المتمثلة في نظافة أماكن التنفيذ العقابي والنظافة الشخصية وتوفير وجبات الغذاء وغيرها، ورعاية صحية علاجية متمثلة في علاج المحبوس من الأمراض التي تصيبه أثناء قضائه للعقوبة المحكوم بها عليه وحتى التي كان يعاني منها قبل حبسه، كما يراعى في معاملة المحبوس إبقاء صلته بالعالم الخارجي كتلقي الزيارات والاتصال الهاتفي والمراسلات وغيرها وهذه المعاملة هي التي تسمح بنجاح عملية الإصلاح وإعادة الإدماج.

Most of the world's legislation has tended to espouse a modern punitive policy based on the ideas of the social defense movement, which is mainly based on correction, education of convicts and their reintegration into the social environment. In order to attain this objective, several international charters and national laws establish the basic principles of punitive treatment that make it possible to achieve the goal of punishment through humane treatment and the development of a set of curative and correctional programs during the deprivation of liberty. The humane treatment is based on preserving the dignity of the prisoner during the punitive execution, prohibiting the use of cruelty towards the prisoners and providing the necessary health care, be it preventive, represented in the cleanliness of the places of punitive execution, personal hygiene, provision of meals, etc., and the curative health care represented in the treatment of the prisoner of the diseases that affect him while he is serving his sentence, even the one he suffered before. In the treatment of the detainee, it must be taken into account that he must maintain a link with the outside world, such as receiving visits, telephone calls, correspondence, etc. As a result, this treatment allows the success and completion of the reeducation, reorientation and reintegration process.
