The principle of subsidiarity conditions the effective respect in the internal legal order of the rights guaranteed by the C.E.D.H. But it is also the guarantor of the balance of relations between States Parties / European Court of Human Rights, postulating that the intervention of the national authority must be primary and that of the European Court subsidiary. Le principe de subsidiarité conditionne le respect effectif dans l’ordre juridique interne des droits garantis par la C.E.D.H. Mais il est aussi le garant de l’équilibre des relations États parties/ Cour européenne des droits de l’homme, postulant que l’intervention de l’autorité nationale doit être première et celle de la Cour européenne subsidiaire. |
