The Court has been dealing with mass litigation arising out of different problems in the Contracting States for nearly two decades. These human rights deficiencies in the Contracting States give rise to constantly growing numbers of applications to the Court. At the heart of the present applications lies the division of competence established by the Convention between, on the one hand, the Court, whose function is to “ensure the observance of the engagements undertaken by the High Contracting Parties in the Convention and the Protocols thereto” and, on the other, the Committee of Ministers “which shall supervise [the] execution” of the final judgments of the Court. La Cour européenne des droits de l’homme doit faire face depuis près de vingt ans à un contentieux de masse découlant de différents problèmes dans les États contractants. Ces déficiences en matière de droits de l’homme au sein des États membres engendrent un nombre sans cesse croissant de requêtes auprès de la Cour. Au coeur des requêtes introduites devant la Cour se trouve la répartition des compétences établie par la Convention européenne des droits de l’homme entre, d’un côté, la Cour, dont la fonction est d’assurer le respect des engagements résultant pour les Hautes Parties contractantes de la Convention et de ses Protocoles, et de l’autre côté, le Comité des Ministres, qui surveille l’exécution des arrêts définitifs de la Cour |
