|a جاء القانون ليحمي الحقوق المنوطة بالأشخاص لما لهذه الحماية من أهمية على المستوى الداخلي والدولي، وكغيره من الحقوق جاءت الحقوق الأدبية والفنية بتنظيم خاص وقانون خاص يحمي أصحاب هذه الفئة من التعديات التي لحقت بهم خاصة في ضل انتشار وسائل التقليد والقرصنة لهذا جاء القانون 03-05 الذي نظم حقوق حق المؤلف على مصنفه الأدبي والفني كوسيلة لزجر المعتدين على هذه الحقوق المهمة في رقي وتطور الشعوب.
