المستخلص: تعتبر الدراسة الحالية من الدراسات الهامة وذلك لأنها تعالج أحد أهم القضايا الراهنة على الساحة الدولية، وذلك لأنها تناولت التطور الذي لحق بمفهوم التدخل العسكري الإنساني من جهة الطرف الذي يقوم به فضلا عن التعرف على الاعتبارات السياسية التي رافقت تطبيقه وأثرت بشكل كبير في مسيرته وتوصلت الدراسة إلى مجموعة من النتائج كان من أهمها إن التغيرات التي رافقت النظام العالمي الجديد قد أثرت في مفهوم السيادة الوطنية ونطاق تطبيقه في المجالين الداخلي والخارجي على حد سواء فهناك علاقة ضرورية بين المتغيرات التي رافقت النظام الدولي وتقلص السيادة الوطنية، كما يوجد علاقة طردية بين تأثر سيادة الدولة بمتغيرات النظام الدولي والتغير الحاصل في مضمون الوظائف التي تقوم بها الدولة، فقد اتخذت عملية تدويل السيادة منحى وسع أبعادها الخارجية، فالقاعدة الأساسية التي يقوم عليها المجتمع الدولي هي الاعتراف المتبادل بين دول ذات سيادة، إلا أنها اتسعت بصورة معينة أدت إلى وضع شروط لممارسة الدولة حقوق السيادة، وأهمها ألا يتسبب من جراء تلك الحقوق أي اضطراب في النظام العالمي وإن مجلس الأمن شرع تدخلات عدة متخطيا بذلك مبدأ السيادة، إلا أن التمعن الدقيق في النتائج يشير إلى أن المجلس لم يجرؤ على القيام بذلك إلا عندما كانت الدولة العراقية ضعيفة وانتهاكات حقوق الإنسان فيها عالية جدا، وأنه على العكس فقد امتنع عن القيام بذلك حينما كانت الدولة قوية، أما بالنسبة لتوصيات الدراسة فكان من أهمها بأنه لابد من بذل الجهد في التوعية والتثقيف ولاسيما أن تأكيد الأهمية العالمية لحقوق الإنسانية في مناسبات كثيرة يمهد إلى ممارسة التدخل الإنساني على وفق آليات وقواعد وأسس الحماية الدولية لحقوق الإنسان، وضرورة إجراء تعديل علة نصوص ميثاق الأمم المتحدة لتتلاءم مع المستجدات والتطورات الدولية، ولا بد من وجود نصوص جديدة تعالج هذه المسألة وبصورة دقيقة لا بعبارات فضفاضة ذات قراءات عدة توجه الفكر القانوني نحو تفسيرات ونتائج مختلفة متعارضة.

The current study is considered one of the important studies because it deals with one of the most important current issues on the international scene, because it dealt with the development of the concept of humanitarian military intervention on the part of the party that performs it, as well as identifying the political considerations that accompanied its application and greatly influenced its path. set of results, the most important of which was that the changes that accompanied the new world order had affected the concept of national sovereignty and the scope of its application in the internal and external fields alike. There is a necessary relationship between the changes that accompanied the international system and the shrinkage of national sovereignty. There is also a direct relationship between the influence of state sovereignty on the variables of the international system and the change in the content of the functions that the state performs. The process of internationalizing sovereignty has taken a turn that expands its external dimensions. International recognition is the mutual recognition between sovereign states, but it expanded in a certain way that led to the setting of conditions for the exercise of the rights of sovereignty, the most important of which is that these rights not cause any disturbance in the global system. And that the Security Council initiated several interventions bypassing the principle of sovereignty, but a careful examination of the results indicates that the Council did not dare to do so except when the Iraqi state was weak and human rights violations were very high, and that, on the contrary, it refrained from doing so when the state was Strong, as for the recommendations of the study, the most important of them was that effort must be made in raising awareness and education, especially since affirming the global importance of human rights on many occasions paves the way for the practice of humanitarian intervention in accordance with the mechanisms, rules and foundations of international protection. Human rights, and the need to amend the text of the United Nations Charter to suit international developments and developments, and there must be new texts that deal with this issue accurately and not in broad terms with several readings that direct legal thought towards different interpretations and conflicting results.
