|a يتحدث هذا المقال عن مختلف الضمانات التي منحها المشرع المغربي للمتهم لحماية حريته الشخصية أثناء مرحلة البحث التمهيدي، حيث أحاط مختلف الإجراءات المتخذة من لدن الضابطة القضائية، بعدة شروط وضمانات على رأسها خضوع المحضر لرقابة النيابة العامة، وإمكانية إبطال المحضر إذا لم تحترم الضابطة الشروط والضمانات المنصوص عليها، وكذلك حق الدفاع في الاطلاع على المحضر، كما أحاط الحراسة النظرية بعدة ضمانات حيث منح المتهم الحق في الاتصال بمحاميه، وإخبار عائلته باعتقاله، وحقه في التغذية والتطيب، بالإضافة إلى تحديد الوقت القانوني للتفتيش ومن قبل من لحماية حقوق وحريات المتهم خلال هذه المرحلة حتى لا تتعسف الضابطة القضائية وتخضع للقانون أثناء أداء المهام المنوطة بها.
