تهدف الدراسة إلى تطوير قواعد مهنية منهجية تشكل خارطة طريق للأداء المهني المتميز لعملية سماع الأقوال والاستجواب لتنمية وتطوير قدرات ومهارات مأموري الضبط القضائي والمحققين، وتمكينهم من إظهار الحقيقة بمهارة ومهنية عالية، دون اللجوء إلى الإكراه المادي أو المعنوي وانتهاك الحقوق والحريات الشخصية، والتزام السلطات المختصة بسماع الأقوال والاستجواب بالمهنية العالية والأداء المتميز وفقا لمبدأ الشرعية، والعمل على تطوير بيئة سماع الأقوال والاستجواب بتصميم غرف خاصة لهذا الغرض بمواصفات محددة . ومن أجل تحقيق أهداف الدراسة، تم تقسيمها إلى فصلين : جاء الفصل الأول تحت عنوان "مفهوم سماع الأقوال والاستجواب " واشتمل على ثلاثة مباحث، تناول المبحث الأول " أهداف وخصائص سماع الأقوال " وتمثلت الأهداف في جمع المعلومات من الأشخاص الذين بحوزتهم معلومات مفيدة لمرحلة الاستدلال أو التحقيق، وتتميز مرحلة سماع الأقوال بمجموعة من الخصائص المهمة التي يجب على السلطات المختصة إدراكها جيدا والتعامل معها بمهنية وكفاءة عالية. وتناول المبحث الثاني من الفصل الأول "أهداف وخصائص الاستجواب "، ومن أهم أهداف الاستجواب الحصول على حقائق قيمة للإثبات تؤكد وتدعم صحة توجيه الاتهام، أو حقائق تشكك في صحة الاتهام أو تنفيه واستبعاد الأبرياء من دائرة الاشتباه، والتعرف على الجاني، والحصول على الاعترافات بالطرق المشروعة. ومن أبرز خصائص الاستجواب الصفة الاتهامية والسعي للحصول على اعتراف المتهم بالطرق المشروعة ومعرفة الحقيقة. وجاء المبحث الثالث من الفصل الأول تحت عنوان : "أهمية وفوائد سماع الأقوال قبل الاستجواب وأوجه الشبه بينهما". الفصل الثاني بعنوان : "منهجية سماع الأقوال والاستجواب " وهو من مبحثين، تناول الأول "أهمية إلمام المحقق بالمعلومات الحقيقية المتوفرة وتقييمها قبل بداية سماع الأقوال أو الاستجواب " وتشمل السجلات والوثائق وأقوال المجني عليه والشهود واستعراض وفحص نتائج التحقيق وتنمية قدرات ومهارات تحليل الحقائق، وتم تدعيم موضوعات هذا المبحث بالسوابق القضائية. أما المبحث الثاني فقد جاء بعنوان : "أهمية الخصوصية أثناء سماع الأقوال والاستجواب " تناول المطلب الأول منه "آليات وقواعد سماع الأقوال ميدانيا " وبحث المطلب الثاني "أهمية مراعاة الخصوصية في مواصفات غرفة سماع الأقوال والاستجواب " . وقد توصلت الدراسة إلى مجموعة من النتائج المهمة التي أكدت على منهجية سماع الأقوال والاستجواب، كما قدم الباحث توصيات علمية تدعم تنمية وتطوير القدرات والمهارات، ورفع الكفاءة وترشيد الأداء بالمهنية العالية في مجال سماع الأقوال والاستجواب .
The study seeks to develop methodological professional norms regarded as a roadmap for excellent professional performance of hearing statements and interrogation. The aim of laying down these norms is to improve the skills of judicial police officers and detectives , together with enabling them to uncover the truth highly professionally, without acting under duress or violating their personal right to freedom. The norms can also make competent authorities abide by hearing statements and interrogating the suspect in accordance with the principle of legality, in addition to creating a better environment for this through designing special rooms for this sake. In order to realize this study objectives, it is divided into two main chapters: The first chapter is entitled "The Concept of Hearing Statements and Interrogation ", which includes three subchapters. The first subchapter touches on " Aims and Features of Hearing Statements «The aims of this subchapter arc represented in gathering data from people who possess valuable information in the investigation period. The hearing statements period is marked by a number of significant characteristics that competent authorities have to realize and cope with very well. The second subchapter tackles " Aims and Features of Interrogation Of the most weighty aims of interrogation is to gain vital data that ascertain the validity of indictment or data that disclaim and deny it. Other aims lie in removing the innocent from the circle of suspicion, identifying the perpetrator and gelling confession out of the offender in a legal manner. Interrogation is thus marked by accusatory capacity . The third subchapter has the title " The Importance and Benefits of Hearing Statements Before Interrogation and their Similarities The second chapter " Methodology of Hearing Statements and Interrogation" comprises two subchapters, the first of which addresses "The Importance of the Detectives Acquaintance with Actual Existing Data and Assessing them before Hearing Statements and Interrogation ".These data include records, documents, the victim's and witness statements, besides reviewing and examining the investegation results. The topics of this subchapter have been consolidated by judicial precedents. The second subchapter is " The Importance of Privacy during Hearing Statements and Interrogation ". The first theme of the latter subchapter handles " Mechanisms and Rules of Hearing Statements in Field ", while the second one discusses ” The Importance of Considering Privacy in Traits of Hearing Statements and Interrogation Room ". The study has arrived at a number of substantial findings that emphasize the methodology of hearing statements and interrogation. Furthermore, the researcher has drawn some recommendations that stress the importance of developing capacities and skills, elevating efficiency and rationalizing professional performance in regard to hearing statements and interrogation.
