المستخلص: التجريم والعقاب ضرورة يجب أن تقدر بقدرها، فلا إفراط ولا تفريط، تطبيقا لذلك تقوم سياسة التجريم على التوفيق بين ضرورة حماية المجتمع من الجريمة، وأولوية احترام الحقوق والحريات، وحتى يحقق ذلك التوازن فإن على المشرع الجنائي، تحت رقابة القضاء، أن يتقيد بمجموعة من المبادئ الدستورية التي تشكل قيدا على سلطة الدولة في التجريم والعقاب، وضمانة للحقوق الحريات، ومن أهمها مبدأ الضرورة والتناسب الذي يقضي بعدم الزج بآلية الردع الجنائي في كل صغيرة وكبيرة، بل عليه أن يحرص على عدم استعمالها إلا عند الضرورة القصوى، ومفاد ذلك أن التجريم لكي يكون مبررا لا بد أن يكون ضروريا ومتناسبا.

In application of this, the criminalization policy is based on reconciling the need to protect society from crime, and the priority of respecting rights and freedoms, and in order to achieve that balance, the criminal legislator must, under the supervision of the judiciary, adhere to a set of principles Constitutional law, which constitutes a restriction on the state's authority in criminalization and punishment, and a guarantee of rights and freedoms, the most important of which is the principle of necessity and proportionality, which requires that the mechanism of criminal deterrence not be used in every small and large matter, but rather he must be careful not to use it except when absolutely necessary, and the meaning of this is that criminalization is in order to Justification must be necessary and proportionate.

La criminalisation et la punition sont une nécessité qu'il convient d'évaluer en conséquence. En appliquant cela, la politique criminelle s'appuie sur la conciliation de la nécessité de protéger la société contre le crime et de la priorité du respect des droits et des libertés.
