|a يتناول هذا البحث أساس قوة الارتباط القانوني بين الحكم الجزائي الذي يصدر إلى الموظف العام من المحاكم الجزائية وبين القرار التأديبي الذي يصدر عن الجهات التي تمتلك سلطة فرض العقوبات التأديبية، يتمثل هذا الارتباط في قوة المساءلة الجزائية على إثارة التحقيق الذي تقوم به الجهات الإدارية إذا ارتكب الموظف جريمة جنائية وتمت مباشرة الإجراءات الجنائية بحقه، وكذلك يتمثل هذا الارتباط بالتزام محكمة قضاء الموظفين العراقية في الحكم الجزائي فيما يتعلق بإثبات الواقعة ونسبها إلى فاعليها ووصفها القانوني، حيث إن هذا الأمر يقيد محكمة قضاء الموظفين ويجعل من الارتباط قوة قانونية لا يمكن التخلي عنه وإلا كانت الإجراءات باطلة.
|b This research deals with the basis of the strength of the legal link between the penal judgment issued to the public employee from the criminal courts and the disciplinary decision issued by the authorities that have the authority to impose disciplinary penalties. A criminal offense and criminal procedures were initiated against him, as well as this link is represented by the commitment of the Iraqi Staff Judiciary Court in the penal ruling with regard to proving the incident and attributing it to its perpetrators and its legal description, as this matter restricts the Staff Judicial Court and makes the link a legal force that cannot be abandoned. Otherwise, the procedures are void.
