تعتبر التكنولوجيا في المجال الطبي من أهم التطورات التي شهدها عصرنا الحالي لما قدمته من تسهيلات عظيمة سواء بالنسبة للطبيب أو المريض من خلال ابتكار أجهزة ومعدات وتوفير آلات وأدوية جديدة ساهمت في حماية العديد من الأشخاص وحسنت فرص علاجهم كما كان لها دورا فعالا في تحسين الأبحاث والدراسات العلمية لجعل الرعاية الصحية أكثر كفاءة وعليه أصبح التطور التكنولوجي في المجال الطبي واقعا لا رجعة فيه، خاصة في مجال نقل الأعضاء كطريقة علاجية جديدة، وأيضا ابتكار تقنية التلقيح الاصطناعي لمساعدة الأفراد في تحقيق أمنية الإنجاب بالإضافة إلى تطوير عمليات الاستنساخ البشري، ولا شك أن هذا التطور أثر على حرمة الكيان الجسدي للإنسان الذي يعتبر من أهم العناصر اللازمة لوجوده، لذا كان من الضروري التوفيق بين غايتين متلازمتين وهما الحرص على تطبيق مبدأ حماية السلامة الجسدية للإنسان والاستجابة لمقتضيات التطور التكنولوجي الطبي، وهذا ما جعل المشرع يشعر بضرورة التدخل ووضع ضوابط تضمن حماية حق الإنسان في سلامة جسده من المخاطر التي تهدده جراء التطور التكنولوجي.
Technology in the medical field is considered as one of the main developments that our current century had witnessed, because of the great facilities it offered to both the doctor and patient through the invention of devices and equipment, providing machines and new medicines that contributed in protecting many people it improved their treatment (recovery) chances. It also had an effective role improving the scientific research and studies to make the healthcare more efficient. Hence, the technological development in the medical field has become an irreversible reality, especially in the “organ transplantation field” as a new treatment method. Also innovating the artificial insemination technique to help individuals fulfill their wish of childbearing (having children). In addition to developing the human cloning operations. There is no doubt that this development has affected (influenced) the sanctity (inviolability, immunity) of the physical entity of the human which is one of the most important elements that are necessary of his/her existence. Therefore, it was necessary to reconcile between the two col-linear goals that are: ensuring the application of the principle of human physical integrity protection(human body protection) on the one hand and responding to the requirements of medical technology developments on the other hand, that is what made the legislator realize the necessity to intervene and establish regulations and principles that insure the protection of human right in keeping body safe from dangers that threatens it due to the technological development.
