المستخلص: تبرز أهمية هذا البحث إلى بيان الحقوق والواجبات التي فرضتها الشريعة الإسلامية، واهتمت بها اهتماما بالغا، من أجل ضمان تحقيق الحياة المنشودة، ولكي تؤدي الدور الذي رسمه الله تعالى في بناء الأسرة القائمة على أساس الاحترام المتبادل، وتناولت في هذه الدراسة ما يرتبه عقد الزواج من حقوق وواجبات زوجية، وما يقتضيه من آثار معنوية ومادية في العلاقات الأسرية وتضمنت الموضوعات التالية منها: أهمية الزواج ومشروعيته وحكمه وأركانه وصيغه، إضافة إلى بيان حقوق الزوج على الزوجة، وحقوق الزوجة على الزوج، والحقوق المشتركة بين الزوجين، وتوصلت الدراسة إلى بيان أهم النتائج منها: 1. بينا مشروعية النكاح من خلال استعراض النصوص القرآنية والروايات الدالة على ذلك. 2. وضحنا أهمية الزواج حماية الإنسان من طغيان الشهوة، وحماية الذرية من ضياع الأنساب، وانحراف التربية، وإعفاف المرء وزوجه من الوقوع فيما حرمه الله تعالى. 3. توصلنا إلى بيان صحة عقد الزواج وهي الشهادة، حيث تم اختلاف الفقهاء في اشتراطها، من خلال بيان آرائهم إضافة إلى الشروط التي يجب أن يتحلى بها الشاهد من حيث العقل والبلوغ والإسلام والعدالة. 4. بينت الدراسة أبرز حقوق الزوج على زوجته، وللزوجة على زوجها حقوق قد تكون مادية وغير مادية، وللزوجين أيضا حقوق مشتركة بينهما.

The importance of this research highlights the statement of the rights and duties imposed by the Islamic Sharia, and took great care of them, in order to ensure the achievement of the desired life, and in order to play the role that God Almighty has ordained in building the family based on mutual respect, In this study, I dealt with what the marriage contract entails in terms of marital rights and duties, and its moral and material effects on family relations. The following topics were included, The importance of marriage, its legitimacy, its ruling, its pillars and its formulas, in addition to clarifying the rights of the husband over the wife, the rights of the wife over the husband, and the common rights between the spouses. The study reached a statement of the most important results, including: 1. We clarified the legality of marriage by reviewing the Qur’anic texts and the narrations that indicate this. 2. We have explained the importance of marriage as protecting a person from the tyranny of lust, protecting offspring from loss of lineages, deviation in upbringing, and chastening one and his spouse from falling into what God Almighty has forbidden. 3. We reached a statement of the validity of the marriage contract, which is the certificate, where the jurists differed in its requirement, by stating their opinions in addition to the conditions that the witness must have in terms of reason, puberty, Islam and justice. 4. The study showed the most prominent rights of the husband over his wife, and the wife has rights over her husband that may be material and non-material, and the spouses also have common rights between them.
