|a هذا البحث دراسة في فساد (عقود النكاح) عند الإمام الشافعي في كتابه الأم من حيث أصل العقد وشروطه، من خلال سبع مسائل: الأولى: حكم النكاح بغير ولي ولا سلطان، والثانية: حكم تزويج الولي المرأة بغير رضاها، والثالثة: حكم نكاح المتعة، والرابعة: حكم النكاح بغير شهود، والخامسة: النكاح بشرط الخيار، والسادسة: حكم نكاح المحرم في الحج، والسابعة: حكم النكاح في العدة. بدأت بتعريف بالمسألة، ثم ذكرت نص قول الإمام الشافعي فيها، وبعدها ذكرت أقوال العلماء فيها وأدلتهم، ثم عمدت إلى ذكر القول الراجح بعد دراسة للمسألة.
|b This article is a study of the corruption of (marriage contracts) according to Imam Al-Shafi’i in his book Al-Umm in terms of the origin and conditions of the contract, through seven issues: the first: the ruling on marriage without a guardian or authority , the second: the ruling on the guardian marrying a woman without her consent ،and the third: the ruling on temporary marriage, The fourth: the ruling on marriage without witnesses, the fifth: the marriage with the condition of choice ،the sixth: the ruling on marrying a Muharram during Hajj ،and the seventh: the ruling on marriage during the waiting period. I started by defining the issue ،then I mentioned the text of Imam Al-Shafi’i’s statement about it ،and then I mentioned the sayings of scholars about it and their evidence, then proceeded to mention the most correct opinion after studying the issue.
