يجيء هذا البحث؛ ليلفت الأنظار إلى سبق التشريع الإسلامي في سن أحكام وقواعد الوقاية من أزمات الأوبئة وما شبهها. وقد راعيت بيان منهج الشريعة الإسلامية في مقاومة الأوبئة والجوائح والتعامل مع الأزمات المصاحبة لها: على مستوى بيان الأحكام، وعلى مستوى ما يحيط بالأحكام الشرعية، وهو يشمل النظر على مستوى المقاصد والقيم العليا، وعلى مستوى القواعد الضابطة، وعلى مستوى الإجراءات التدبيرية (فقه التدبير)، مع لفت العناية إلى استجلاء حكمة التشريع الإسلامي، والإفادة من توالي أحداث الزمان في استجلاء المزيد من الحكم الربانية والسنن الإلهية الكامنة خلف ما شرعه الله من أحكام، وما سنه من أنظمة وتدابير، وما قدره على العباد من أحداث تسفر عما يكون به تثبيت لأفئدة المؤمنين، وهداية لألباب الشاردين والمذبذبين. كما عنيت فيه بالالتفات للجوانب الأخلاقية المتعلقة بالتعامل مع أزمات كالأوبئة؛ إذ أسفرت الأزمة الحالية (وباء كوفيد 19 ومتحوراته) عن جملة من الإشكاليات القانونية والأخلاقية والاقتصادية التي تستدعي الدراسة من منظور تشريعي وأخلاقي إسلامي، فيصير البحث بذلك معنيا بتناول الموضوع من منظور أخلاقي وتشريعي إسلامي يكشف عن مستويات تحليلية متنوعة، من شأنها تحقيق تجلية أشمل لجوانب الظاهرة محل الدراسة. كما ضممت إلى هذا الغرض إبداء الرأي في جملة من أهم القضايا التي أثيرت وطرحت للنقاش في خضم الأزمة، وانقسمت فيها الآراء، غير أن بعض من أدلى فيها بدلوه لم يؤسس رؤيته على علم راسخ يجمع بين فقه والوحي وفقه الواقع، فرأيت الحاجة قد اشتدت إلى الأبحاث -التي تجمع بين هذين الفقهين -في منهج الشريعة الإسلامية في حفظ الفرد والمجتمع ووقايتهما من المخاطر، وسبق الشريعة الإسلامية في كثير من هذه الجوانب.

I also meant in it to pay attention to the ethical aspects related to dealing with crises such as epidemics; As the current crisis (Covid 19 epidemic and its mutants) has resulted in a number of legal, ethical and economic problems that require study from an Islamic legislative and ethical perspective, the research thus becomes concerned with dealing with the subject from an Islamic moral and legislative perspective that reveals various analytical levels that would achieve a more comprehensive manifestation of the aspects of the phenomenon.
