المستخلص: يهدف البحث إلى بيان أهم المفاهيم ذات الصلة بالموضوع مثل: (الضوابط- الاستثمار الرقمي- رؤية مصر ۲۰۳۰ م... الخ)، وكذلك بيان المنهج التشريعي للاستثمار الرقمي ومشروعيته والأدلة وعرض أركان الاستثمار الرقمي وشروطه وأهم القواعد الفقهية الحاكمة مثل: (الضرر يزال، والمشقة تجلب التيسير، وهل العبرة في العقود بصيغها أو بمعانيها؟)، وتوضيح علاقة الاستثمار الرقمي بالمقاصد الشرعية في ضوء منزلة المال ثم في التشريعات الوضعية كالدستور المصري والتشريعات القانونية الأخرى، والتوصل لأهم الضوابط مثل: (إخلاص النية ابتغاء للرزق الحلال وحلية المال وتحديد الاحتياجات الضرورية للاستثمار الرقمي... الخ مع عرض لأهم التطبيقات الفقهية مثل الاستثمار الهرمي والعقود الذكية والعملات الرقمية وختاما بأهم النتائج ومنها: الضوابط: أمر كلي يجمع ما يقع تحته من فروع في باب واحد والأصل في الاستثمار الرقمي المشروعية وكذلك أهم التوصيات ومنها اتساع نطاق البحث الشرعي الفقهي ليشمل كل الجوانب المعاصرة، وخلق بيئة جاذبة للاستثمارات الرقمية في الوطن العربي والإسلامي بضوابطها الشرعية.

The research aims to clarify the most important concepts related to the topic, such as: (Controls- Digital Investment- Egypt Vision 2030... etc.), as well as a statement: the legislative approach to digital investment, its legitimacy and evidence and the presentation of the pillars and conditions of digital investment and the most important rules of jurisprudence such as: (The harm is removed, and the hardship brings facilitation, and is the moral in contracts in their forms or their meanings?) and clarifying the relationship of digital investment to legitimate purposes in the light of the status of money and then in man-made legislations such as the Egyptian Constitution and other legal legislation, and reaching the most important controls such as: (fidelity of intention for halal livelihood and the ornament of money And the identification of the necessary needs for digital investment ... etc., with a presentation of the most important jurisprudential applications such as: hierarchical investment, smart contracts and digital currencies, and finally with the most important results including: Controls: a total matter that combines the branches that fall under it in one chapter and the origin in the legal digital investment, as well as the most important recommendations, including: Expanding the scope of legal jurisprudential research to include all contemporary aspects, and creating an environment Attractive for investments in the Arab and Islamic world.
