المستخلص: ارتبطت صورة المغرب في السنوات الأخيرة بحوادث عبور متكررة لمهاجري إفريقيا جنوب الصحراء نحو الضفة الأخرى عن طريق ما يسمى بقوارب الموت. فموقع المغرب الجغرافي كنقطة التقاء بين أوروبا وأفريقيا جعلته ينتقل من دولة عبور للمهاجرين القادمين من أفريقيا جنوب الصحراء إلى دولة استقبال واستقرار للعديد منهم. ووعيا منه بالدور المنوط به في تدبير ظاهرة الهجرة غير الشرعية، عمل المغرب على تقوية ترسانته القانونية المنظمة للهجرة غير الشرعية من أجل تأطير وضعية المهاجرين المتواجدين على ترابه الوطني، حيث عزز قوانينه الوطنية في مجال الهجرة وصادق على مجموعة من المعاهدات والاتفاقيات الدولية ذات الصلة. كما انخرط المغرب عبر مختلف المؤسسات المعنية في وضع استراتيجية وطنية للهجرة قصد الحد من تداعياتها على الأصعدة الاجتماعية والأمنية والسياسية والقانونية والاقتصادية. وعلى الرغم من مجهودات المغرب الرامية إلى الحد من تفاقم ظاهرة الهجرة غير الشرعية من موقعه كفاعل إقليمي ودولي في تدبير الملف، إلا أنه اصطدم بمجموعة من العقبات والتعثرات على المستويين الوطني والدولي جعلتنا كمهتمين بالهجرة غير الشرعية، نتساءل عن آفاق تدبير هذا الملف بالمغرب من خلال طرح إشكالية تروم معرفة مدى نجاعة السياسة المعتمدة من طرف المغرب في تدبير واقع الهجرة غير الشرعية واستشراف مستقبلها على أراضيه. للإجابة عن هذه الإشكالية، عمدنا إلى رصد واقع الهجرة غير الشرعية في المغرب، في ظل أهم التشريعات الوطنية والدولية كمحور أول خلصنا من خلاله إلى أهمية النصوص القانونية التي اعتمدها المغرب ودورها في تنظيم حياة المهاجرين المتواجدين على أراضيه، في حين تطرقنا في المحور الثاني إلى أفاق سياسة المغرب في مجال تدبير الهجرة غير الشرعية والتي رصدنا من خلالها ضرورة تجاوز المقاربة الأمنية التي ينهجها المغرب إلى مقاربة حمائية تنبني على تكريس المكتسبات الحقوقية لضمان الاندماج السوسيو- اقتصادي للمهاجرين رغم ما يطرحه ذلك من صعوبات تكتنف الرهانات التي يفرضها واقع الحال. واعتمدنا في دراستنا لهذه الإشكالية المنهج الكمي لتجميع المعلومات والنصوص والدراسات وتحليلها في أفق توظيفها، إلى جانب المنهج الوصفي التحليلي لرصد مؤشرات التحليل المعتمد في دراسة الفئة موضوع المقالة.

Recently, Morocco’s image has been associated, with the incidents relating to frequent sub-Saharan migrants crossings attempting to reach the other shore through the so-called boats of death. Due to its geographical location as a meeting point between Europe and Africa, Morocco has evolved from a transit country to a destination and a settlement country for migrants from sub-Saharan Africa. Conscious of its role in managing the phenomenon of illegal immigration, Morocco has updated its body of legislative enactments relating to illegal immigration in order to regulate the situation of immigrants living on its soil, by strengthening its national immigration legislation and by ratifying a set of international treaties and conventions in the field of migration. Morocco has also been involved through the mobilization of different institutions in the development of a national migration strategy in order to limit its repercussions on the social, security, political, legal and economic levels. However, despite its efforts in tackling the growing phenomenon of illegal immigration- from its position as a regional and international actor in managing migration issues- Morocco comes up with a number of difficulties and obstacles both on national and international levels; which made us, as interested entities, wonder about the prospects for managing illegal immigration in Morocco by assessing the effectiveness of the Moroccan policy in managing the illegal immigration and its issues as well as anticipating its future on its territory. So as to solve this issue ̶ as a first part ̶ we observed the illegal immigration in Morocco in light of the most important national and international legislations and we concluded the importance of the legislation adopted by Morocco and its role in regulating the situation of immigrants living on its lands. Whereas in the second part, we discussed the prospects for Morocco’s policy in managing the illegal immigration and noted the need to move beyond the security approach to a protectionist approach based on perpetuating human rights gains to ensure the socio-economic integration of immigrants, despite the difficulties and the challenges posed. In this study, we adopted the quantitative approach to collect and analyze information, legal texts and studies. In addition, we used the descriptive analytical approach so as to monitor the indicators of the analysis used in the study above.
