المستخلص: تهدف هذه الدراسة إلى بيان القوة التي تتمتع بها المبادئ التوجيهية الخاصة بالنزوح عند تقديم العمل الإنساني للنازحين جراء النزاعات المسلحة، ومدى التزام الدول والمنظمات الدولية الحكومية وغير الحكومية بأحكامها، وتوضيح ما إذا كانت هذه المبادئ كافية بحد ذاتها لحماية ومساعدة النازحين أم لا، ولتحقيق هذه الأهداف استخدمت الباحثة المناهج التالية: المنهج الوصفي والتحليلي للتعرف على الأحكام التي تضمنتها المبادئ التوجيهية المتعلقة بالنزوح، ودراسة وتحليل مضمونها ومدى تغطيتها لاحتياجات النازحين المختلفة، والمنهج المقارن للحصول على فهم أعمق حول فكرة القيمة القانونية للمبادئ التوجيهية الخاصة بالنزوح، من خلال مقارنة الأحكام التي تضمنتها بتلك المنصوص عليها في القانون الدولي العام بفروعه المختلفة، وتوصلت الدراسة إلى عدد من النتاج أهمها: أن أغلب الأحكام التي نصت عليها المبادئ التوجيهية مستمدة من القانون الدولي الإنساني والقانون الدولي لحقوق الإنسان والقانون الدولي للاجئين، وأنها وإن لم تصغ على شكل اتفاقية ملزمة إلا أنها أصبحت تتمتع بقوة إلزامية تستمدها من القانون الدولي العام الذي استمدت أحكامها منه، ومن الانتشار العالمي لها وتطبيقها على مختلف المستويات الدولية والإقليمية والمحلية، وأوصت الدراسة بتوصيات منها: العمل على إصدار اتفاقية دولية خاصة بالنازحين، والنص فيها على أن الأحكام الواردة لا تلغي أو تنتقص من الحقوق الأخرى التي تقرها المواثيق الدولية والتشريعات الوطنية، وتشجيع الدول على إصدار سياسات وقوانين خاصة بالنزوح، تبين فيها الحقوق القي يتمتع بها النازحون، والتزامات الدول تجاههم، والآليات التي تضمن تنسيق الجهود وتحقيق الاستجابة المثلى لاحتياجات النازحين.

This study aims to study the value of the Guiding Principles on Internal Displacement in Humanitarian work, the compulsion states and organizations of these provisions, and if the principles are enough to protect and help IDPs. To achieve the study's objectives, the researcher used the following methodologies; the descriptive and analytical methodology to identify the Guiding Principles on Internal Displacement and the provisions they included, as well as to study and analyze their content and if they cover the different needs of the internally displaced persons, and the comparative methodology to have a deeper understanding of the idea of the legal value of the Guiding Principles on Internal Displacement, by comparing the provisions they contain with those stipulated in various branches of Public International Law. The study reached several conclusions: Most of the Guiding Principles provisions are derived from International Humanitarian Law, International Human Rights Law, and International Refugees Law, the Guiding Principles were not formulated in a binding agreement form, they have become a binding force that derives from the Public International Law which they derived from, also from the global spread of Principles, and their application at the various international, regional and local levels. The study offered various recommendations: Working to issue an international convention for IDPs, and stipulating in it provisions mentioned do not cancel, restrict or derogate from other rights recognized by international documents and national legislation, and encouraging countries to issue policies and laws related to displacement contain the rights of IDPs, the countries responsibilities, and the mechanisms that ensure coordination of efforts and achieve an optimal response to the needs of IDPs.
