المستخلص: أصبح أمن المعلومات ضرورة حتمية داخل جمع المؤسسات، ولذلك تسعي الدولة لتوفيره، فإن لم تتوافر حماية المعلومات سيؤدي ذلك إلى فوضي واضطراب يلحق الضرر بالمصالح العامة والخاصة. وفي ظل التطور الرقمي أصبح الوصول للمعلومات واعتراضها والتطفل عليها أمرا متاحا لبعض الجواسيس والقراصنة مما شكل تهديدا للمؤسسات الإدارية ليس من داخل حدود الدولة وحسب بل من خارجها، فقد تسبب التحول الرقمي في إزالة الحدود الزمنية والمكانية للدول. ومن أهم صور تهديد أمن المعلومات، هو اعتراضها ومنع تدفقها، والسطو عليها واستغلالها استغلال غير مشروع، أو تدميرها وإتلافها، وهو ما يتطلب التدخل التشريعي لحمايتها. وفي سبيل حماية الأمن المعلوماتي إصدار المشرع حزمة من التشريعات التي تعتبر المعلومات من الأسرار التي يحظر الاطلاع عليها، تجريم محاولة اختراقها، أو نشرها أو إذاعتها، وكذلك تجريم إتلافها أو تزويرها، وكذلك تجريم استخدامها استخدام غير مشروع. ونعتقد أن أهمية التدخل التشريعي تبدو في توفير بيئة مناسبة لملاحقة التطور المذهل في تقنيات الرقمنة والذكاء الاصطناعي، ومن ثم تظهر الصلة الوثيقة بين القانون وبين التحول الرقمي.

Information security has become an inevitable necessity within all institutions, and the state seeks to provide it. If information protection is not available, this will lead to chaos and disorder that harm public and private interests. In light of digital development, accessing, intercepting, and intruding on information has become available to some spies and hackers, which has posed a threat to administrative institutions not only from within the borders of the state but also from outside it. The digital transformation has caused the removal of the temporal and spatial boundaries of states. The most important forms of threat to information security are intercepting it, preventing its flow, stealing it, illegally exploiting it, or destroying it, which requires legislative intervention to protect it. In order to protect information security, the legislator issued a package of legislation that considers information as one of the secrets that it is forbidden to access, criminalizes attempting to penetrate, publish or broadcast it, as well as criminalizing its destruction or falsification, as well as criminalizing its illegal use. We believe that the importance of legislative intervention appears to be in providing an appropriate environment to pursue the amazing development in digitization and artificial intelligence technologies, and thus the close link between the law and digital transformation appears.
